Canada: Drill pipe Termination of anti-dumping duty investigations

On May 24, 2022, pursuant to paragraph 35(1)(b) of the Special Import Measures Act (SIMA), the Canadian International Trade Tribunal (CITT) determined that the evidence does not disclose a reasonable indication that the dumping and subsidizing of certain drill pipe from China have caused injury or retardation or are threatening to cause injury to the domestic industry. Therefore, pursuant to paragraph 35(3)(a) of SIMA, the CITT terminated the preliminary injury inquiry with respect to the subject goods. Consequently, the Canada Border Services Agency, pursuant to paragraph 35(2)(a) of SIMA, terminated the investigations of dumping and subsidizing in respect of certain drill pipe from China, effective May 25, 2022. 

Canada: Upholstered domestic furniture Notice of normal value review

The Canada Border Services Agency (CBSA) has initiated a normal value review (review) to update all normal values and export prices applicable to certain upholstered domestic furniture (UDS) from China by Henglin Home Furnishings Co., Ltd. (Henglin). The review follows a request for re‑determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on September 2, 2021, respecting the dumping and subsidizing of UDS from China and Vietnam in accordance with the Special Import Measures Act (SIMA). The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s order are contained in Appendix 1 (subject goods).

Should the exporter decide to participate in this review, it is required to provide complete and accurate response to the CBSA’s Request for Information (RFI) by July 8, 2022. The exporter will be considered cooperative if the requested information is complete, submitted on time and the exporter permits verification of the data. 

Canada: Notice of extension of investigations on Mattresses

The Canada Border Services Agency has extended the preliminary phase of the investigations into the alleged injurious dumping and subsidizing of mattresses from China. The Special Import Measures Act (SIMA) provides that, under normal circumstances, the preliminary stage of the investigations shall be completed within 90 days of the date of initiation. However, due to the existence of circumstances that, in the opinion of the CBSA, make it unusually difficult to decide within ninety days whether to make preliminary determinations or to terminate the investigations with respect to some or all of the goods, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA. Consequently, the decision to issue preliminary determinations or to terminate the investigations with respect to some or all of the goods will be made on or before July 7, 2022. 

Canada: concludes normal value review on exporter of carbon steel fasteners from Taiwan

The Canada Border Services Agency (CBSA), on June 9th, 2022, concluded a normal value review to determine normal values and export prices applicable to certain carbon steel fasteners exported to Canada from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Taiwan) by Honor Best Co., Ltd. This means that anti-dumping duties will not be payable to imports of subject goods from this exporter provided that they are sold to Canada at or above the normal values issued by CBSA. 

China: Announcement on the Final Review of the Anti-dumping Measures against Imports of Chloroprene Rubber CR)Originating in Japan,United States and EU

The MOFCOM received a formal application for expiry review on anti-dumping measures officially submitted by representatives from Chloroprene Rubber industry and claim if the anti-dumping measures is terminated, the dumping behavior and injury to the industry in China might continue or reoccur, and requested the MOFCOM to maintain the anti-dumping measures against imports of Chloroprene Rubber originating in Japan, United States and EU (excl. UK).

In accordance with the Anti-dumping Regulations of the People's Republic of China, the MOFCOM reviewed the qualifications of the applicants, the products under investigation, similar domestic products, the imports of the product under investigation during the implementation of the anti-dumping measures, the possibility of continuity or re-occurrence of dumping, the possibility of continuity or re-occurrence of damages or related evidence. Current evidence shows that the applicants meet the provisions specified in Article 11, Article 13 and Article 17 of the Anti-dumping Regulations of the People's Republic of China on industry and industry representativeness, and therefore, they are eligible to apply on behalf of Chinese Chloroprene Rubber industry. The investigation authority believes that the applicants' claim and the prima facie evidence submitted are in conformity with the requirements for an expiry review.

According to Article 48 of the Anti-dumping Regulations of the People's Republic of China, the MOFCOM decides to conduct an expiry review investigation into the anti-dumping measures imposed on the imports of Chloroprene Rubber originating in Japan, United States and EU as of May 10, 2022.

This investigation starts from May 10, 2022 and ends prior to May 10, 2023. As suggested by the MOFCOM and decided by the Customs Tariff Commission of the State Council, during the expiry review investigation of the anti-dumping measures, the imports of Chloroprene Rubbe originating in Japan, United States and EU will still be subject to anti-dumping duties at the scope and rate released in MOFCOM Announcement No. 23 of 2005 in the meanwhile measures on imports from the UK shall be terminated. 

India: imposed anti-dumping duty on imports of Styrene Butadiene Rubber

Per CBIC Notification No. 17/2022-Customs (ADD), India has imposed anti-Dumping Duty on imports of "Styrene Butadiene Rubber" originating in or exported from European Union, Korea RP and Thailand till 31.10.2022. 

India: imposed anti-dumping duty on imports of tyres

Per CBIC Notification No. 09/2022-Customs (ADD), India has imposed anti-Dumping Duty on imports of specified types of Tiles from China for a period of further five years. 

United States: Preliminary Determination in the Antidumping Duty Investigation of Emulsion Styrene-Butadiene Rubber

On June 15, 2022, the Department of Commerce announced its affirmative preliminary determinations in the antidumping duty (AD) investigations of emulsion styrene-butadiene rubber (Harmonized Tariff Schedule of the United States subheadings 4002.19.0015 and 4002.19.0019) from the Czech Republic and Russia. 

United States: Preliminary Determination in the Countervailing Duty Investigations of Barium Chloride from India

On June 14, 2022, the Department of Commerce announced its affirmative preliminary determination in the countervailing duty (CVD) investigation of barium chloride (HTSUS 2827.39.4500) from India. 

United States: Preliminary Determination in the Countervailing Duty Investigations of Sodium Nitrite from India

On June 14, 2022, the Department of Commerce announced its affirmative preliminary determination in the countervailing duty (CVD) investigation of sodium nitrite (Harmonized Tariff Schedule of the United States (HTSUS) subheading 2834.10.1000) from India. 

United States: Preliminary Determination in the Antidumping Duty Investigation of Superabsorbent Polymers from the Republic of Korea

On June 1, 2022, the Department of Commerce announced its affirmative preliminary determination in the antidumping duty (AD) investigation of certain superabsorbent polymers (HTSUS subheading 3906.90.5000) from the Republic of Korea.

United States: Preliminary Determination in the Countervailing Duty Investigations of Certain Steel Nails from India, Oman, Sri Lanka, Thailand, and Turkey

United States: Final Determination in the Antidumping Duty Investigation of Freight Rail Coupler Systems and Certain Components Thereof from China

On May 24, 2022, the Department of Commerce announced its affirmative final determinations in the antidumping duty (AD) investigation of freight rail coupler systems and certain components thereof (subheading 8607.30.1000) from China.
