Canada: Notice of close of record and updated schedule of Oil country tubular goods and seamless casing 

The Canada Border Services Agency (CBSA) has now closed the record of the expedited review of certain oil country tubular goods (OCTG) and seamless casing exported from China, to Canada by Linzhou Fengbao Pipe Industry Co., Ltd. The expedited review is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) finding, respecting the dumping and subsidizing of certain OCTG and seamless casing from China, in accordance with the Special Import Measures Act (SIMA).

Canada: Conclusion of normal value review of Carbon steel fasteners

The Canada Border Services Agency (CBSA) has concluded a normal value review (review) to determine normal values and export prices of certain carbon steel fasteners (fasteners) exported to Canada from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) by Jau Yeou Industry Co., Ltd. (Jau Yeou). The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on September 2, 2020 in Expiry Review No. RR-2019-002, respecting the dumping of fasteners originating in or exported from the People’s Republic of China (China) and the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), and the subsidizing of such goods, originating in or exported from China, excluding fasteners specifically designed for application in the automotive or aerospace industry, in accordance with the Special Import Measures Act (SIMA). The importation of the subject goods are usually classified under the following tariff classification numbers (classification numbers): 7318.11.00.00; 7318.12.00.00; 7318.14.00.00; 7318.15.00.10; 7318.15.00.42; 7318.15.00.45 and 7318.15.00.49.

Canada: Notice of extension of expedited review of Upholstered domestic seating

The Canada Border Services Agency (CBSA) has extended the conclusion of the expedited review of certain upholstered domestic furniture (UDS), exported to Canada by the exporter Kaiser 2 Furniture Industry (Vietnam) Co., Ltd.

Canada: Initiation of expiry review investigation: Copper pipe fittings 2 (CPF2 2023 ER)

The Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on May 25, 2018, in inquiry no. NQ-2017-004, concerning the dumping and subsidizing of certain copper pipe fittings originating in or exported from the Socialist Republic of Vietnam. As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the rescission of the finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. The CBSA will make a determination no later than June 15, 2023, and will issue a statement of reasons by June 30, 2023. The subject goods are “Pressure pipe fittings and drainage, waste and vent pipe fittings, made of cast copper alloy, wrought (or “wrot”) copper alloy or wrought copper for use in heating, plumbing, air conditioning and refrigeration applications originating in or exported from the Socialist Republic of Vietnam, restricted to the products enumerated in Appendix 1.” The subject goods are usually classified under the following tariff classification numbers: 7412.10.00.11; 7412.10.00.19; 7412.10.00.90; 7412.20.00.11; 7412.20.00.12; 7412.20.00.19 and 7412.20.00.90.

EU acts against dumped ceramic tiles from India and Türkiye

The Commission imposed definitive anti-dumping measures on imports of ceramic tiles originating from India and Türkiye for a period of five years. This follows an investigation which was initiated in December 2021 and showed that EU producers were harmed by dumped imports from India and Türkiye. The injury sustained by EU producers of ceramic tiles resulted in a loss of sales despite a growing EU market for ceramic tiles. The measures imposed will defend EU producers – mostly small- and medium-sized enterprises that employ a total of 55,000 people across the EU – by re-establishing fair competition between imported and EU-produced tiles. Ceramic tiles are produced across the EU, with particularly high concentrations of producers in Spain, Italy, Poland and Portugal. The welfare of producers in such clusters markedly impacts other up- and downstream industries and their employees.

The anti-dumping duties imposed range from 6.7% to 8.7% for ceramic tiles from India and from 4.8% to 20.9% for ceramic tiles from Türkiye. In addition to measures on ceramic tiles originating in India and Türkiye, anti-dumping measures are currently in place on imports of ceramic tiles from China, as well as on ceramic tableware and kitchenware from China.

EU maintains duties on aluminium road wheels from China

The European Commission extended anti-dumping duties on aluminium road wheels from China for another five years. The extension follows an expiry review investigation, which showed that the wheels continue to be dumped on the EU market and that the EU industry – which employs 17,000 people – would suffer significant harm if the measures were allowed to lapse. The duties on aluminium road wheels from China remain at 22.3% and continue to ensure fair competitive conditions on the EU market between imports from China and domestic production. As such, they have been complemented by anti-dumping duties of between 9% to 17.5% on aluminium road wheels from Morocco, which were confirmed on 12 January 2023.

EU acts against dumped fatty acid from Indonesia

The European Commission imposed anti-dumping duties on fatty acid from Indonesia. This follows an investigation which showed that EU industry was being harmed by dumped imports because it could not compete on price, resulting in a market share loss. The anti-dumping duties imposed range from 15.2% to 46.4%. They will help to ensure fair competition between fatty acid imported from Indonesia and locally produced fatty acid. Fatty acid is widely used in food, cosmetics and medicines. Palm oil is a key raw ingredient of fatty acid.

A definitive anti-dumping duty is imposed on imports of ceramic flags and paving, hearth or wall tiles; ceramic mosaic cubes and the like, whether or not on a backing; finishing ceramics, currently falling under CN codes 6907 21 00, 6907 22 00, 6907 23 00, 6907 30 00 and 6907 40 00 and originating in India or Türkiye.

European Union: Notice of initiation of an expiry review of the anti-dumping measures applicable to imports of certain corrosion resistant steels originating in People’s Republic of China

Following the publication of a Notice of impending expiry of the anti-dumping measures in force on the imports of certain corrosion resistant steels originating in People’s Republic of China (‘the country concerned’ or ‘PRC’), the European Commission (‘the Commission’) has received a request for review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union.

The product subject to this review is flat-rolled products of iron or alloy steel or non-alloy steel; aluminium killed; plated or coated by hot dip galvanisation with zinc and/or with aluminium, and no other metal; chemically passivated; containing by weight: 0,015 % or more but not more than 0,170 % of carbon, 0,015 % or more but not more than 0,100 % of aluminium, not more than 0,045 % of niobium, not more than 0,010 % of titanium and not more than 0,010 % of vanadium; presented in coils, cut-to-length sheets and narrow strips. The following products are excluded:

  • of stainless steel, of silicon-electrical steel, and of high-speed steel,
  • not further worked than hot-rolled or cold-rolled (cold-reduced).

European Union: initiating a ‘new exporter’ review of Implementing Regulation (EU) 2021/607 imposing a definitive anti-dumping duty on imports of citric acid 

EU has initiated a ‘new exporter’ review of Implementing Regulation (EU) 2021/607 imposing a definitive anti-dumping duty on imports of citric acid originating in the People’s Republic of China for one Chinese exporting producer, repealing the duty with regard to imports from that exporting producer and making these imports subject to registration. The product under review is citric acid and trisodium citrate dihydrate, currently falling under CN codes 2918 14 00 and ex 2918 15 00 (TARIC codes 2918 15 00 11 and 2918 15 00 19) and originating in the PRC.

European Union: Notice of initiation of an expiry review of the anti-dumping measures applicable to imports of certain cast iron articles originating in the People’s Republic of China

Following the publication of a Notice of impending expiry of the anti-dumping measures in force on the imports of certain cast iron articles originating in the People’s Republic of China (‘the PRC’ or ‘the country concerned’), the European Commission (‘the Commission’) has received a request for review pursuant to Article 11 of Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union. 
The product subject to this review is certain articles of lamellar graphite cast iron (grey iron) or spheroidal graphite cast iron (also known as ductile cast iron), and parts thereof. These articles are of a kind used to:

  • cover ground or sub-surface systems, and/or openings to ground or sub-surface systems, and also
  • give access to ground or sub-surface systems and/or provide view to ground or sub-surface systems.

The articles may be machined, coated, painted and/or fitted with other materials such as but not limited to concrete, paving slabs, or tiles (‘the product under review’).

The following product types are excluded from the definition of the product under review:

  • channel gratings and cast tops subject to standard EN 1433, to be fitted as a component on channels in polymer, plastic, galvanised steel or concrete allowing surface water to flow into the channel,
  • floor drains, roof drains, cleanouts and covers for cleanouts, subject to standard EN 1253,
  • step irons, lifting keys, and fire hydrants.

The product under review is currently falling under CN codes ex 7325 10 00 and ex 7325 99 10 (TARIC codes 7325 10 00 31 and 7325 99 10 60). The CN and TARIC codes are given for information only, without prejudice to a subsequent change in the tariff classification.

European Union: imposing a definitive anti-dumping duty on imports of certain aluminium road wheels 

EU has imposed a definitive anti-dumping duty on imports of certain aluminium road wheels originating in the People’s Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The product under review is aluminium road wheels of the motor vehicles of CN headings 8701 to 8705, whether or not with their accessories and whether or not fitted with tyres and originating in the PRC (‘the product concerned’ or ‘aluminium wheels’ or ‘ARW’), currently falling under CN code(s) ex 8708 70 10 and ex 8708 70 50 (TARIC codes 8708 70 10 15, 8708 70 10 50, 8708 70 50 15 and 8708 70 50 50).

India levies anti-dumping duty on Phthalic anhydride 

Per the CBIC notification no. 43/2021-Customs(ADD), Indi has levied anti-dumping duty on Phthalic anhydride to amend the name of the producer from "Aekyung Petrochemical Co. Ltd." to "Aekyung Chemical Co., Ltd."

United States: Initiates Antidumping Duty Investigations of Tin Mill Products

On February 8, 2023, the U.S. Department of Commerce (Commerce) announced the initiation of antidumping duty (AD) investigations of tin mill products from Canada, the People’s Republic of China (China), Germany, the Republic of Korea (Korea), the Netherlands, Taiwan, the Republic of Turkey (Turkey), and the United Kingdom, and a countervailing duty (CVD) investigation of tin mill products from China.

United States: Initiates Antidumping Duty Investigations of Gas Powered Pressure

On January 20, 2023, the U.S. Department of Commerce (Commerce) announced the initiation of antidumping duty (AD) investigations of gas powered pressure washers from the People’s Republic of China (China) and the Socialist Republic of Vietnam (Vietnam), and a countervailing duty (CVD) investigation of gas powered pressure washers from China. U.S. Census Bureau, accessed through IHS Markit’s Global Trade Atlas (Harmonized Tariff Schedule of the United States (HTSUS) subheading 8424.30.9000).  Imports of gas powered pressure washers enter under an HTSUS subheading that may cover subject and non-subject merchandise.
