Canada: Notice of close of record and updated schedule of Steel Piling Pipe 

The Canada Border Services Agency (CBSA) has now closed the record of the normal value review (review) of certain steel piling pipe (piling pipe) originating in or exported from China by Shanghai Electric Power Transmission & Distribution Engineering Co., Ltd. The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on January 17, 2024, in Expiry Review No. RR-2022-005, respecting the dumping and the subsidizing of piling pipe originating in or exported from China, in accordance with the Special Import Measures Act (SIMA).

Canada: Notice of close of record and updated schedule of Aluminum extrusions (AE 2024 UP1)

The Canada Border Services Agency (CBSA) has now closed the record of the export price review (review) of certain aluminum extrusions originating in or exported from China by Guangdong Luoxiang Aluminium Co., Ltd. The review is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on January 13, 2020, in Expiry Review No. RR-2018-008, respecting the dumping and subsidizing of certain aluminum extrusions originating in or exported from China, in accordance with the Special Import Measures Act (SIMA).

Canada: Notice of initiation of undertaking review of Sucker rods 2 (SR2 2024 UR)

The Canada Border Services Agency (CBSA) has initiated undertaking reviews, pursuant to paragraph 53(1) of the Special Import Measures Act (SIMA), in relation to certain sucker rods from exporting parties Metalmecanica S.A. from Argentina, Confab Industrial S.A. from Brazil, and Tubos de Acero de Mexico S.A. from Mexico. The CBSA will make a determination no later than January 27, 2025, and will issue a Statement of Reasons by February 11, 2025.

EU: Anti-dumping on imports of certain graphite electrode systems

COMMISSION IMPLEMENTING REGULATION (EU) 2024/2686 of 17 October 2024 initiating an investigation concerning possible circumvention of the anti-dumping measures imposed by Implementing Regulation (EU) 2022/558 on imports of certain graphite electrode systems originating in the People’s Republic of China by imports of artificial graphite in blocks or cylinders originating in the People’s Republic of China and making such imports subject to registration.

Within the context of the above-mentioned regulation, new TARIC codes have been created: 3801 10 00 15/80, 3801 10 00 85/80, 3801 90 00 80/10, 3801 90 00 80/80,  3801 90 00 85/80. And code 3801 90 00 90/80 has been closed and absorbed by 3801 90 00 80/80 and 3801 90 00 85/80. New measures 564 (anti-dumping or countervailing registration) have been created.

EU imposes duties on unfairly subsidised electric vehicles from China while discussions on price undertakings continue

The European Commission concluded its anti-subsidy investigation by imposing definitive countervailing duties on imports of battery electric vehicles (BEVs) from China for a period of five years. As previously disclosed, the investigation found that the BEV value chain in China benefits from unfair subsidization which is causing threat of economic injury to EU producers of BEVs. As a result, the duties will enter into force on the day following publication in the Official Journal.
In parallel, the EU and China continue to work towards finding alternative, WTO-compatible solutions that would be effective in addressing the problems identified by the investigation. The Commission also remains open to negotiating price undertakings with individual exporters, as is permitted under EU and WTO rules.

  • Countervailing duties imposed for five years

As from the entry into force of the measures, sampled Chinese exporting producers will be subject to the following countervailing duties:

  • BYD: 17.0%
  • Geely: 18.8%
  • SAIC: 35.3%

Other cooperating companies will be subject to a duty of 20.7%. Following a substantiated request for an individual examination, Tesla will be assigned a duty of 7.8%. All other non-cooperating companies will have a duty of 35.3%. Definitive duties will be collected as of entry into force. The provisional duties imposed on imports of BEVs from China on 4 July 2024 will not be collected.

  • Ensuring the effectiveness and fairness of measures

Going forward, the Commission will monitor the effectiveness of the measures in force, including to ensure that they are not circumvented. Any exporting producer who cooperated and is subject to the sample average duty, or who is a new exporter, is entitled to request an accelerated review to establish an individual duty rate. The measures will expire at the end of the 5-year period unless an expiry review is initiated before that date. Importers may request a refund if they believe their exporting producer is not subsidised or if their subsidy margin is less than the duties paid by the importers. Such a request should be duly substantiated and supported by the respective evidence.

The EU: making imports of epoxy resins subject to registration 

Making imports of epoxy resins originating in the People’s Republic of China, the Republic of Korea, Taiwan and Thailand subject to registration. The product subject to registration (‘the product concerned’) is products containing more than 35 % by weight of epoxy resins, also known as epoxide resins or polyepoxides, which are polymers or prepolymers containing reactive epoxy groups, based on epichlorohydrin and an aliphatic or aromatic alcoholic component (such as BPA), in solid, semi-solid or liquid forms, having all types of grade, purity, molecule weight or molecular structure, whether or not containing modifiers, curing agents, or additives, so long as the curing agents have not chemically reacted so as to cure the epoxy resin or convert it into a different product no longer containing epoxy groups. The product concerned is currently classified under CN codes ex 2910 90 00, ex 3824 99 92, ex 3824 99 93, and ex 3907 30 00 (TARIC codes 2910 90 00 05, 3824 99 92 96, 3824 99 93 10, 3907 30 00 05, 3907 30 00 20, and 3907 30 00 80). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification.

The EU: making imports of steel track shoes originating in the People’s Republic of China subject to registration

The product subject to registration (‘the product concerned’) is certain types of steel shoes, with or without rubber pads attached thereto, whether or not assembled in a track chain, with a maximum length of 3 000 mm, used on machines currently falling under headings 8426 , 8429 or 8430 , or conveyor belts currently falling under heading 8428. The product concerned is currently classified under CN codes ex 8431 49 20, ex 8431 39 00, and ex 8431 49 80 (TARIC codes 8431 49 20 10, 8431 39 00 20 and 8431 49 80 10). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification.

The EU: making imports of optical fibre cables originating in India subject to registration

The product subject to registration (‘the product concerned’) is single mode optical fibre cables, made up of one or more individually sheathed fibres, with protective casing, whether or not containing electric conductors, whether or not connectorized. The following products are excluded:

  • Cables below 500 meters in length in which all the optical fibres are individually fitted with operational connectors at one or both extremities; and
  • Cables for submarine use, plastic insulated, containing a copper or aluminium conductor, in which fibres are contained in metal module(s).

The product concerned is currently classified under CN code ex 8544 70 00 (TARIC codes 8544 70 00 10 and 8544 70 00 91). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification.

The EU: making imports of mobile access equipment originating in the People’s Republic of China subject to registration

The product subject to registration (‘the product concerned’) is mobile access equipment designed for the lifting of persons, self-propelled, with a maximum working height of 6 meters or more, and pre-assembled or ready-to assemble sections thereof, excluding individual components when presented separately, and excluding person lifting equipment mounted on vehicles of Chapter 86 and Chapter 87 of the Harmonised System.

The product concerned is currently classified, for the MAE, under CN codes ex 8427 10 10, ex 8427 20 19, ex 8428 90 90 and, for the pre-assembled or ready-to-assemble sections of MAE, under ex 8431 20 00 and ex 8431 39 00 (TARIC codes: 8427 10 10 10, 8427 20 19 10, 8428 90 90 20, 8431 20 00 60 and 8431 39 00 10). On November 7, 2024, the U.S. Department of Commerce (Commerce) announced its preliminary affirmative determinations in the antidumping duty (AD) investigations of epoxy resins from People’s Republic of China (China), India, the Republic of Korea (Korea), Taiwan, and Thailand. Commerce is conducting concurrent countervailing duty (CVD) investigations of epoxy resins from China, India, Korea, and Taiwan. Product subject to this notice classified under HTS 3907.30.0000.
