Canada: Notice of initiation of expiry review investigation - Corrosion-Resistant Steel Sheet

On January 15, 2024, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on February 21, 2019, in Inquiry No. NQ-2018-004, concerning the dumping of certain corrosion-resistant steel sheet originating in or exported from China, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), India and South Korea. As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the finding is likely to result in the continuation or resumption of dumping of the subject goods. The CBSA will make a determination no later than June 13, 2024, and will issue a Statement of Reasons by June 28, 2024.

Canada: Notice of close of record and updated schedule - Carbon and Alloy Steel Line Pipe 2 

The Canada Border Services Agency (CBSA) has now closed the record of the normal value review of certain carbon and alloy steel line pipe (line pipe) originating in or exported from the Republic of Korea by Dong Yang Steel Pipe Co., Ltd. The updated schedule of this review is now available. Interested parties will now have seven days from the close of the record to file submissions concerning this review.

Canada: Notice of normal value review: Mattresses 

The Canada Border Services Agency (CBSA) has initiated a normal value review (review) to establish the normal values, export prices and amounts of subsidy applicable to mattresses originating in or exported from the People’s Republic of China (China) by Derucci International Holdings Limited. The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) finding issued on November 4, 2022 in Inquiry No. NQ-2022-001, respecting the dumping and subsidizing of mattresses originating in or exported from China, in accordance with the Special Import Measures Act (SIMA). Should the exporter decide to participate in this review, it is required to provide a complete and accurate response to the CBSA’s dumping request for information (RFI) and subsidy RFI by January 29, 2024, by 5 p.m. ET. The exporter will be considered co-operative if the requested information is complete, submitted on time and the exporter permits verification of the data.

Please be advised that exporters who are not the manufacturers of the subject goods (i.e., trading company, vendor, etc.) should ensure that their suppliers/manufacturers have received the dumping RFI and subsidy RFI and that they also provide a complete and accurate response to the two RFIs by January 29, 2024, by 5 p.m. ET. If the CBSA does not receive complete responses to the two RFIs by the deadline date by the exporter and their suppliers/manufacturers, the normal values, export prices and amounts of subsidy for the subject goods will be determined pursuant to a ministerial specification.

Canada: Conclusion of a normal value review: Carbon steel fasteners

The Canada Border Services Agency (CBSA) has concluded a normal value review (review) to establish normal values, export prices and amounts of subsidy applicable to certain carbon steel fasteners (fasteners) originating in or exported from China by Pinghu Gete Auto Fastener Co., Ltd. (Pinghu). The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on September 2, 2020 in Expiry Review No. RR-2019-002, respecting the dumping of fasteners originating in or exported from China and Chinese Taipei, and the subsidizing of such goods, originating in or exported from China, excluding fasteners specifically designed for application in the automotive or aerospace industry, in accordance with the Special Import Measures Act (SIMA).

European Union: Notice of initiation of an expiry review of the anti-dumping measures applicable to imports of aluminium radiators 

Following the publication of a Notice of impending expiry of the anti-dumping measures in force on the imports of aluminium radiators originating in the People’s Republic of China (‘the country concerned’, ‘China’), the European Commission ('the Commission') received a request for review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union ('the basic Regulation'). The request was submitted on 16 October 2023 by AIRAL s.c.r.l. ('the applicant') on behalf of the Union industry of aluminium radiators in the sense of Article 5(4) of the basic Regulation. The product subject to this review is aluminium radiators and elements or sections of which such radiator is composed, whether or not such elements are assembled in blocks, excluding radiators and elements and sections thereof of the electrical type ('the product under review'), currently falling under CN codes ex 7615 10 10, ex 7615 10 80, ex 7616 99 10 and ex 7616 99 90 (TARIC codes 7615 10 10 10, 7615 10 80 10, 7616 99 10 91, 7616 99 90 01 and 7616 99 90 91). European Union: Notice of initiation of an anti-subsidy proceeding concerning imports of certain alkyl phosphate esters, originating in the People’s Republic of China

The European Commission (‘the Commission’) received a complaint pursuant to Article 10 of Regulation (EU) 2016/1037 of the European Parliament and of the Council of 8 June 2016 on protection against subsidised imports from countries not members of the European Union (‘the basic Regulation’), alleging that imports of certain alkyl phosphate esters, originating in the People’s Republic of China, are being subsidised and are thereby causing injury to the Union industry. The product subject to this investigation is certain alkyl phosphate esters based exclusively on side chains with a length of two or three carbon atoms (also includes chlorinated alkyl chains) and with a phosphorus content of at least 9 % (per weight) and a viscosity between 1 and 100 mPa.s (at 20-25 °C) falling under Chemical Abstracts Service (‘CAS’) numbers 13674-84-5, 1244733-77-4 and 78-40-0 (‘the product under investigation’). All interested parties wishing to submit information on the product scope must do so within 10 days of the date of publication of this Notice. The product allegedly being subsidised is the product under investigation, originating in the People’s Republic of China (‘the country concerned’), currently classified under ex CN code 2919 90 00 (TARIC codes 2919 90 00 50 and 2919 90 00 65) and ex CN code 3824 99 92 (TARIC code 3824 99 92 38). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification. European Union: Notice of initiation of an anti-dumping proceeding concerning imports of biodiesel originating in the People’s Republic of China 

The European Commission (‘the Commission’) received a complaint pursuant to Article 5 of Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (‘the basic Regulation’), alleging that imports of biodiesel, originating in the People’s Republic of China, are being dumped and are thereby causing injury to the Union industry.

The product subject to this investigation is fatty-acid mono-alkyl esters and/or paraffinic gasoils obtained from synthesis and/or hydro-treatment, of non-fossil origin, commonly known as ‘biodiesel’, in pure form or as included in a blend (‘the product under investigation’). All interested parties wishing to submit information on the product scope must do so within 10 days of the date of publication of this Notice.

European Union: Notice of initiation of a partial interim review of the anti-dumping measures applicable to imports of melamine originating in the People’s Republic of China 

The European Commission (‘the Commission’) received a request for a partial interim review pursuant to Article 11(3) of Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (‘the basic Regulation’). The partial interim review is limited to the form of the measures, in particular whether or not it is in the Union interest to maintain measures currently in force in the form of minimum import price (‘MIP’) and fixed duties. The request was lodged on 13 November 2023 by LAT Nitrogen, OCI Nitrogen BV and Grupa Azoty Zaklady Azotowe Pulawy SA (‘the applicants’). The applicants requested the Commission to take the necessary action to amend the form of the measures and to impose ad valorem duties instead of the minimum import price (‘MIP’) and fixed duties. 

The product subject to this review is melamine (‘the product under review’), currently falling under CN code 2933 61 00. The CN code is given for information only and without prejudice to a subsequent change in the tariff classification.

European Commission counters unfair imports of shipbuilding components from Türkiye and China

he European Commission imposed duties on imports of bulb flats – niche steel products used in shipbuilding – from Türkiye and China. These measures will defend the EU’s two bulb flat producers, both small and medium enterprises (SMEs), from injury caused by dumped imports from these countries. As such, the measures will protect 140 jobs in Spain and Italy. An anti-dumping investigation found that imports from Türkiye and China were seriously harming the EU industry, which would be unable to compete without measures. Therefore, duties of 23% were imposed on imports from China and 13.6% on imports from Türkiye. Bulb flats are used in the shipbuilding industry as a fortifier of ship hulls, mainly in the construction of passenger cruise ships and military vessels.

European Commission to examine allegations of unfairly traded biodiesel from China

The European Commission has launched an investigation into allegations of dumping of biodiesel from China onto the EU market. If dumping is confirmed and is found to be harming EU producers, the Commission may impose measures (typically duties on imports) to remedy the effects of the unfair trading if such measures are in the EU’s interest. The EU market in biodiesel is worth €31 billion annually, providing a renewable alternative to fossil fuels in the EU's transport sector and improving the EU's security of energy supply. The launch of the anti-dumping investigation is based on a complaint by EU biodiesel producers. EU producers have submitted evidence of biodiesel imports from China coming into the EU at artificially low prices and claim that these imports are seriously harming their industry, because they cannot compete with such low prices. The EU industry employs 3,700 people across 18 Member States: Austria, Belgium, Bulgaria, Cyprus, Czechia, Denmark, Finland, France, Germany, Greece, Ireland, Italy, the Netherlands, Poland, Portugal, Romania, Slovakia and Spain.

United States: Final Determinations in the Antidumping Duty Investigations of Tin Mill Products from Eight Trading Partners and the Final Determination in the Countervailing Duty Investigation of Tin Mill Products

On January 5, 2024, Commerce announced the final determinations in the antidumping duty (AD) investigations of tin mill products from Canada, the People’s Republic of China (China), Germany, the Republic of Korea (Korea), the Netherlands, Taiwan, the Republic of Turkey (Turkey), and the United Kingdom. Commerce also announced the final determination in the accompanying countervailing duty (CVD) investigation of tin mill products from China. Products subject to anti-dumping duty are classified under tariff codes 7210.11.0000, 7210.12.0000, 7210.50.0020, 7210.50.0090, 7210.50.0000, 7212.10.0000, 7212.50.0000, 7225.99.0090, and 7226.99.0180.

United States: Preliminary Affirmative Determinations in the Antidumping Duty (AD) Investigations of Certain Paper Shopping Bags

On December 28, Commerce announced affirmative preliminary determinations in the AD investigations of certain paper shopping bags from Cambodia, China, Colombia, India, Malaysia, Portugal, Taiwan, Turkey, and Vietnam. Commerce is conducting concurrent countervailing duty investigations on imports of certain paper shopping bags from China and India. Products subject to anti-dumping duty are classified under tariff codes 4819.30.0040 and 4819.40.0040.

United States: Preliminary Negative Determination in the Countervailing Duty Investigation of Mattresses

On December 27, 2023, the U.S. Department of Commerce (Commerce) announced its preliminary negative determination in the countervailing duty (CVD) investigation of mattresses from Indonesia.
