Canada: Notice of initiation of normal value review of Oil country tubular goods and seamless casing (OS 2024 UP2)

The Canada Border Services Agency (CBSA) has initiated a normal value review to update normal values, export prices and amounts of subsidy applicable to certain oil country tubular goods (OCTG) and certain seamless casing (SC) exported to Canada from China by Yantai Lubao Steel Pipe Co., Ltd. The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s orders issued on:

  • November 28, 2018, in Expiry Review No. RR-2017-006 (SC) and
  • December 10, 2020, in Expiry Review No. RR-2019-005 (OCTG I)

The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s orders can be found on the CBSA’s Measures in force.

Should the exporter decide to participate in this review, it is required to provide a complete and accurate response to the CBSA’s dumping and subsidy requests for information (RFIs) by September 5, 2024. The exporter will be considered co-operative if the requested information is complete, submitted on time and the exporter permits verification of the data. Please be advised that exporters who are not the manufacturers of the subject goods (i.e., trading company, vendor, etc.) should ensure that their suppliers/manufacturers have received the dumping and subsidy RFIs and that they also provide complete and accurate responses to the two RFIs by September 5, 2024. The merchandise covered by this investigation may be classified under HTS 7304.29.00.12, 7304.29.00.13, 7304.29.00.14, 7304.29.00.15, 7304.29.00.16, 7304.29.00.17, 7304.29.00.19, 7304.29.00.22, 7304.29.00.23, 7304.29.00.24, 7304.29.00.25, 7304.29.00.26, 7304.29.00.27, 7304.29.00.29.

Canada has decided on provisional measures regarding anti-dumping duties and countervailing duties on High Protein Content Pea Protein from China. (HS: 3504.00.90.00, 2106.10.00.00)

On July 22, 2024, the Canada Border Services Agency (CBSA), pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), made preliminary determinations of dumping and subsidizing respecting high protein content pea protein from China. The subject goods are usually classified under the following tariff classification numbers: 3504.00.90.00 and 2106.10.00.00. The above-listed tariff classifications cover both subject and non-subject goods and are for convenience of reference only. Refer to the product definition, for authoritative details regarding the subject goods. Provisional duties will now be payable on the subject goods from China that are released from the CBSA on or after July 22, 2024.

Canada: Notice of initiation of expiry review investigation of Thermoelectric Containers (TC 2024 ER)

On July 29, 2024, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on September 5, 2019, in Expiry Review No. RR-2018-004, concerning the dumping and subsidizing of certain thermoelectric containers originating in or exported from China. As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. The CBSA will make a determination no later than December 24, 2024, and will issue a Statement of Reasons by January 8, 2025.

Canada: Notice of extension of investigation of Certain concrete reinforcing bar 5 (RB5 2024 IN)

The Canada Border Services Agency has extended the preliminary phase of the investigation respecting the alleged injurious dumping of certain concrete reinforcing bar originating in or exported from Bulgaria, Thailand, and the United Arab Emirates. The Special Import Measures Act (SIMA) provides that, under normal circumstances, the preliminary stage of the investigation shall be completed within 90 days of the date of initiation. However, due to the difficulties in obtaining satisfactory evidence and the complexity and novelty of issues presented in the investigation, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA. Consequently, the decision to issue a preliminary determination or to terminate the investigation with respect to some or all of the goods will be made on or before September 13, 2024.

European Union (EU): Notice of initiation of an expiry review of the anti-subsidy measures applicable to imports of certain polyethylene terephthalate originating in India

European Union has published notice of initiation of an expiry review of the anti-subsidy measures applicable to imports of certain polyethylene terephthalate originating in India. The product subject to this review is polyethylene terephthalate (‘PET’) having a viscosity number of 78 ml/g or higher (‘the product under review’), currently falling under CN code 3907 61 00. The CN code is given for information only without prejudice to a subsequent change in the tariff classification.

European Union (EU): Notice of initiation of an anti-dumping proceeding concerning imports of glyoxylic acid originating in the People’s Republic of China 

European Union has published notice of initiation of an anti-dumping proceeding concerning imports of glyoxylic acid originating in the People’s Republic of China. The complaint was lodged on 10 June 2024 by WeylChem Lamotte SAS (‘the complainant’), the sole producer of glyoxylic acid in the EU. The complaint was made by the Union industry of glyoxylic acid in the sense of Article 5(4) of the basic Regulation.

An open version of the complaint and the analysis of the degree of support by Union producers for the complaint are available in the file for inspection by interested parties. Section 5.6 of this Notice provides information about access to the file for interested parties.

The product subject to this investigation is glyoxylic acid (Chemical Abstracts Service (CAS) Number 298-12-4), of a purity of at least 95 % by dry weight, whether in solid form or as an aqueous solution with a concentration by weight higher than 40 % thereof (‘the product under investigation’).

All interested parties wishing to submit information on the product scope must do so within 10 days of the date of publication of this Notice. The product allegedly being dumped is the product under investigation, originating in the People’s Republic of China (‘the country concerned’, the ‘PRC’), currently classified under CN code ex 2918 30 00 (TARIC code 2918 30 00 13). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification. 

European Union (EU): Notice of initiation of an expiry review of the anti-dumping measures applicable to imports of threaded tube or pipe cast fittings, of malleable cast iron and spheroidal graphite cast iron 

EU has published notice of initiation of an expiry review of the anti-dumping measures applicable to imports of threaded tube or pipe cast fittings, of malleable cast iron and spheroidal graphite cast iron originating in the People's Republic of China and Thailand. The product subject to this review is threaded tube or pipe cast fittings, of malleable cast iron and spheroidal graphite cast iron ('the product under review').

The following products are excluded: bodies of compression fittings using ISO DIN 13 metric thread; malleable iron threaded circular junction boxes without having a lid; ductile iron clamp tees with rubber sealing and an outlet hole; ductile iron grooved end caps for use on grooved steel pipe with a threaded outlet; ductile iron grooved reducers with threaded end; ductile iron grooved reducing tees with a threaded outlet; ductile iron blanking saddles without threaded outlets used to seal a hole in a tube or pipe.

The product under review is currently falling under CN code ex 7307 19 10 (TARIC code 7307 19 10 10 and 7307 19 10 20). The CN and TARIC codes are given for information only without prejudice to a subsequent change in the tariff classification.

European Union (EU): imposing a provisional anti-dumping duty on imports of erythritol 

EU has imposed a provisional anti-dumping duty on imports of erythritol originating in the People’s Republic of China. The product under investigation is erythritol, a four-carbon sugar alcohol (polyol) sweetener made from sugar or glucose, in its pure form or contained in blends containing less than 10 % of other products by weight (‘the product under investigation’). Erythritol is a natural, zero-calorie sweetener with zero glycaemic index. It is used mainly as sugar replacer in food and beverage products, either in its pure form or blended with other ingredients, such as the natural high intensity sweetener stevia. The main segment is tabletop sweeteners, followed by beverages, confectionery, bakery, sports nutrition and other food categories. The product concerned is the product under investigation originating in the PRC, currently falling under CN code ex 2905 49 00 for erythritol in its pure form and CN codes ex 2106 90 92 and ex 2106 90 98 for blended products (TARIC codes 2905 49 00 15, 2106 90 92 65, and 2106 90 98 15) (‘the product concerned’).

European Union (EU): initiating an investigation concerning possible circumvention of the anti-dumping measures imposed by Implementing Regulation (EU) 2021/633 on imports of monosodium glutamate 

EU has initiated an investigation concerning possible circumvention of the anti-dumping measures imposed by Implementing Regulation (EU) 2021/633 on imports of monosodium glutamate originating in the People’s Republic of China by imports of monosodium glutamate consigned from Malaysia, whether declared as originating in Malaysia or not, and making such imports subject to registration. The product concerned by the possible circumvention is monosodium glutamate, classified on the date of entry into force of Commission Implementing Regulation (EU) 2021/633 under CN code ex 2922 42 00 (TARIC code 2922 42 00 10) and originating in the PRC (‘the product concerned’). This is the product to which the measures that are currently in force apply. The product under investigation is the same as the product concerned, currently falling under CN code ex 2922 42 00 but consigned from Malaysia, whether declared as originating in Malaysia or not (TARIC code 2922 42 00 15) (‘the product under investigation’).

European Union (EU): notice of initiation of an expiry review of the anti-dumping measures applicable to imports of ceramic tableware and kitchenware 

EU has published notice of initiation of an expiry review of the anti-dumping measures applicable to imports of ceramic tableware and kitchenware originating in the People’s Republic of China. The product subject to this review is ceramic tableware and kitchenware, excluding ceramic condiment or spice mills and their ceramic grinding parts, ceramic coffee mills, ceramic knife sharpeners, ceramic sharpeners, ceramic kitchen tools to be used for cutting, grinding, grating, slicing, scraping and peeling, and cordierite ceramic pizza-stones of a kind used for baking pizza or bread ('the product under review'), currently falling under CN codes ex 6911 10 00, ex 6912 00 21, ex 6912 00 23, ex 6912 00 25 and ex 6912 00 29 (TARIC codes 6911100090, 6912002111, 6912002191, 6912002310, 6912002510 and 6912002910). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification.

India seeks to impose countervailing duty on imports of Pneumatic Radial Tyre for buses & lorries imported from China PR for a period of 5 years

India customs authority has imposed countervailing duty on imports of Pneumatic Radial Tyre for buses & lorries (Classified under tariff chapter 40) imported from China PR for a period of 5 years.

United States: final Determinations in the Antidumping (AD) Investigations of Mattresses from India, Kosovo, Mexico, and Spain and Countervailing Duty (CVD) Investigations of Mattresses from Indonesia 

On July 16, 2024, the U.S. Department of Commerce (Commerce) announced the final affirmative determinations in the antidumping duty (AD) investigations of mattresses from India, Kosovo, Mexico, and Spain and the final negative determination in the countervailing duty (CVD) investigation of mattresses from Indonesia. Product are classified under harmonized Tariff Schedule of the United States (HTSUS) subheadings 9404.21.0010, 9404.21.0013, 9404.21.0095, 9404.29.1005, 9404.29.1013, 9404.29.1095, 9404.29.9085, 9404.29.9087, and 9404.29.9095).

United States: Preliminary Determinations in the Countervailing Duty Investigations of Melamine from Germany, India, Qatar, and Trinidad and Tobago 

On July 16, 2024, the U.S. Department of Commerce (Commerce) announced its preliminary affirmative determinations in the countervailing duty (CVD) investigations of Melamine from Germany, India, Qatar, and Trinidad and Tobago. Commerce is conducting concurrent antidumping duty (AD) investigations of melamine from Germany, India, Qatar, and Trinidad and Tobago. Products are classified under harmonized Tariff Schedule of the United States (HTSUS) subheading 2933.61.0000).

United States: Countervailing Duty Investigation of Certain Brake Drums from the People’s Republic of China 

On July 10, 2024, the U.S. Department of Commerce (Commerce) initiated a countervailing duty investigation to determine whether certain brake drums (brake drums) from the People’s Republic of China (China) imported into the United States have benefitted from countervailable subsidies.

United States: Antidumping Duty Investigation of Large Top Mount Combination Refrigerator-Freezers from Thailand

On July 9, 2024, the U.S. Department of Commerce (Commerce) initiated an antidumping duty investigation to determine whether large top mount combination refrigerator-freezers (refrigerators) from Thailand are being sold in the United States at less than fair value. The products subject to this investigation are currently classifiable under subheading 8418.10.0075 of the Harmonized Tariff Schedule of the United States (HTSUS). Products subject to this investigation may also enter under HTSUS subheadings 8418.21.0090,
8418.40.0000, and 8418.69.0180.

United States: Less-Than-Fair-Value Investigation of Certain Brake Drums from the People’s Republic of China 

On July 10, 2024, the U.S. Department of Commerce (Commerce) initiated an antidumping duty investigation to determine whether certain brake drums from the People’s Republic of China (China) are being sold in the United States at less than fair value. 

The merchandise covered by this investigation is classifiable under Harmonized Tariff Schedule of the United States (HTSUS) subheading 8708.30.5020. The merchandise covered by this investigation may be classifiable under HTSUS subheading 8708.30.5090 when entered as part of an assembly. Subject merchandise may also enter under HTSUS subheading 8716.90.5060. Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the merchandise covered by this investigation is dispositive.

United States: Commerce Initiates Antidumping and Countervailing Duty Investigations of Low-Speed Personal Transportation Vehicles from the People’s Republic of China

On July 11, 2024, the U.S. Department of Commerce (Commerce) announced the initiation of antidumping and countervailing duty (AD/CVD) investigations of Low-Speed Personal Transportation Vehicles from the People’s Republic of China (China). The merchandise covered by this investigation may be classifiable under subheading 8703.10.5030.

United States: Commerce Initiates Antidumping Duty Investigation of Large Top Mount Combination Refrigerator-Freezers from the Thailand

On July 10, 2024, the U.S. Department of Commerce (Commerce) announced the initiation of an antidumping duty (AD) investigation of large top mount combination refrigerator-freezers from Thailand. The merchandise covered by this investigation may be classifiable under subheading 8418.10.0075.

United States: Utility Scale Wind Towers from the People's Republic of China: Final Results of Expedited Second Sunset Review of the Countervailing Duty Order

The U.S. Department of Commerce (Commerce) finds that revocation of the countervailing duty (CVD) order on utility scale wind towers (wind towers) from the People's Republic of China (China) would be likely to lead to continuation or recurrence of a countervailable subsidy at the levels indicated in the “Final Results of Sunset Review” section of this notice. The merchandise covered by this order are certain wind towers, whether or not tapered, and sections thereof. The merchandise covered by this investigation may be classifiable under subheading 7308.20.00.00, 7308.20.00.20, 8502.31.00.00.

United States: Regarding the anti-dumping and countervailing duties measures for Chinese-made Wooden Cabinets and Vanities and Components Thereof, the United States has determined that wooden cabinets, etc., which are completed in Malaysia or Vietnam using wooden parts manufactured in China and imported to the United States, are subject to anti-dumping and countervailing duties, and has decided to withdraw the investigation into circumvention

The U.S. Department of Commerce (Commerce) determines that certain imports of wooden cabinets and vanities and components thereof (wooden cabinets), completed in Malaysia or the Socialist Republic of Vietnam (Vietnam) using wooden cabinet components or constituent wooden parts manufactured in the People's Republic of China (China), are covered by the scope of the antidumping duty (AD) and countervailing duty (CVD) orders on wooden cabinets from China. Further, Commerce is rescinding the circumvention inquiries that were initiated to determine whether imports of wooden cabinets from Malaysia or Vietnam are circumventing the AD and CVD orders on wooden cabinets from China. The merchandise covered by this investigation may be classifiable under subheading: 9403.40.90.60, 9403.60.80.81, 9403.90.70.80, 9403.91.00.80.
