Canada: Notice of initiation of scope proceeding of Certain carbon steel fasteners

The Canada Border Services Agency (CBSA) initiated a scope proceeding on June 2, 2023, under the Special Import Measures Act (SIMA) respecting certain carbon steel fasteners originating in or exported from the People’s Republic of China (China) and the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei). The scope proceeding is the result of an application filed with the CBSA by National Nail, a potential importer of the goods that are the subject of the application. The scope proceeding will establish whether or not CAMO Edge Screws are subject to the Canadian International Trade Tribunal’s order issued on September 2, 2020, in Expiry Review No. RR-2019-002, concerning the dumping of certain carbon steel fasteners originating in or exported from China and Chinese Taipei and the subsidizing of certain carbon steel fasteners originating in or exported from China. A notice of the conclusion and a copy of the Statement of reasons, which will provide more details about this proceeding, will be available on or before September 29, 2023.

Canada: Notice of normal value review: Hot-rolled carbon steel plate 7 

The Canada Border Services Agency (CBSA) has initiated a normal value review to update all of the normal values and export prices applicable to hot-rolled carbon steel plate and high-strength low-alloy steel plate exported to Canada from South Korea by POSCO. The review is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT’s) order issued on March 13, 2020, in Expiry Review No. RR-2019-001, respecting the dumping of certain hot-rolled carbon steel plate from Brazil, Denmark, Indonesia, Italy, Japan, and South Korea, in accordance with the Special Import Measures Act (SIMA). Should the exporter decide to participate in this review, it is required to provide a complete and accurate response to the CBSA’s dumping request for information (RFI) by July 7, 2023. The exporter will be considered co-operative if the requested information is complete, submitted on time and the exporter permits verification of the data. If the exporter does not provide a complete response to the RFI by the deadline date, any previous normal values issued to the exporter will be revoked and normal values for subject goods exported by the exporter will be determined pursuant to a ministerial specification by advancing the export price of the goods by 59.7%.

China: Announcement on Ruling on Expiry Review of Anti-dumping Measures against Imports of Chloroprene Rubber(CR)Originating in USA,Japan and EU 

MOFCOM released MOFCOM Announcement No. 23 of 2005 on May 10th ,2005 and decided to implement the anti-dumping measures against imports of Chloroprene Rubber originating in the USA, Japan and EU. After the implementation of the original review measures, MOFCOM initiated two period reviews, two expiry reviews and two name-change reviews at the request of relevant interested parties.

On May 9th , 2022, at the request of China chloroprene rubber industry , MOFCOM issued Announcement No. 14 of 2022, deciding to conduct the third expiry review applied to imports of chloroprene rubber from USA, Japan and EU starting from May 10, 2022. MOFCOM has investigated and ruled that the dumping of imports of Chloroprene Rubber originating in USA, Japan and EU may continue or occur again in the Mainland of China and it may continue to cause damage or may again cause damage to the China chloroprene rubber industry if the anti-dumping measures are terminated. In accordance with Article 50 of the Anti-dumping Regulations and the investigation results, MOFCOM suggested continuing to implement the anti-dumping measures by Customs Tariff Commission of the State Council. According to the suggestion of MOFCOM, the Customs Tariff Commission of the State Council then decided to continue to impose anti-dumping duties on imports of Chloroprene Rubber(CR)Originating in USA, Japan and EU for five years starting from May 10th , 2023.

European Union imposed a definitive anti-dumping duty on imports of okoumé plywood 

As per regulation (EU) 2023/1159, EU Commission has imposed a definitive anti-dumping duty on imports of okoumé plywood (Classified under HTS 4412311010) originating in the People’s Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council.

As per regulation (EU) 2023/1122, EU commission has imposed a definitive anti-dumping duty on imports of certain hot-rolled flat products of iron, nonalloy or other alloy steel originating in People’s Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The product under review is currently falling under CN codes 7208 10 00, 7208 25 00, 7208 26 00, 7208 27 00, 7208 36 00, 7208 37 00, 7208 38 00, 7208 39 00, 7208 40 00, 7208 52 10, 7208 52 99,7208 53 10, 7208 53 90, 7208 54 00, 7211 13 00, 7211 14 00, 7211 19 00, ex 7225 19 10 (TARIC code 7225 19 10 90), 7225 30 90, ex 7225 40 60 (TARIC code 7225 40 60 90), 7225 40 90, ex 7226 19 10 (TARIC codes 7226 19 10 91, 7226 19 10 95), 7226 91 91 and 7226 91 99).

European Union imposed a definitive anti-dumping duty on imports of certain graphite electrode systems

As per regulation (EU) 2023/1102, EU commission has imposed a definitive anti-dumping duty on imports of certain graphite electrode systems (Classified under HTS 8545110010 and 8545909010) originating in India following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council.

European Union imposed a definitive anti-dumping duty on imports of rebars 

As per regulation (EU) 2023/1050, EU commission has imposed a definitive anti-dumping duty on imports of rebars originating in the Republic of Belarus following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. Currently product is falling under CN codes ex 7214 10 00, ex 7214 20 00, ex 7214 30 00, ex 7214 91 10, ex 7214 91 90, ex 7214 99 10 and ex 7214 99 95 (TARIC codes 7214 10 00 10, 7214 20 00 20, 7214 30 00 10, 7214 91 10 10, 7214 91 90 10, 7214 99 10 10, 7214 99 95 10).

European Union amending Implementing Regulation (EU) 2020/1080 imposing a definitive anti-dumping duty on imports of solar glass 

As per regulation (EU) 2023/1033, EU commission is amending Implementing Regulation (EU) 2020/1080 imposing a definitive anti-dumping duty on imports of solar glass originating in the People’s Republic of China and Implementing Regulation (EU) 2020/1081 imposing definitive countervailing duties on imports of solar glass (classified under HTS 7007198012, 7007198018, 7007198080 and 7007198085)) originating in the People’s Republic of China.

India seeks to amend notification to change the name of producer

India customs authority seeks to amend the name of the producer viz. “Zhejiang Tsingshan Steel Pipe Co., Ltd.” to “Tsingshan Steel Pipe Co., Ltd”, in pursuance of DGTR recommendation.

United Kingdom: Advance warning concerning imports of optical fibre cables from China

A provisional anti-dumping duty on optical fibre cables from China is being introduced from 9 July 2023. From this date, importers of optical fibre cables will need to give HMRC a guarantee for the provisional duty in the form of cash, bond or a bank guarantee while this provisional duty applies. Importers of goods affected by this measure who wish to provide a guarantee for the provisional anti-dumping duty using a bank guarantee, must apply to HMRC for a general guarantee account.

United Kingdom: Exemption of Ukraine from certain anti-dumping measures and advance notice of DCTS.

The exemption of Ukraine from the UK’s anti-dumping measures on certain hot-rolled flat products of iron, non-alloy or other alloy steel set out in the Trade remedies Authority’s (TRA) public notice 2022/17 has been extended for a further 12 months until 30 May 2024. On 19 June 2023, the Developing Country Trading Scheme (DCTS) will replace the UK General Scheme of Preferences (GSP). DCTS has a wider product coverage, revised country coverage and more liberal origin rules than the GSP regime. DCTS has three different regimes: 

  • Comprehensive preferences
  • Enhanced preferences
  • Standard preferences

United Kingdom: Trade remedies measures on the import of ironing boards from Türkiye have gone live

A provisional countervailing duty on ironing boards from Türkiye (Turkey) is now live (26 May 2023). While this provisional duty applies, importers of ironing boards from Türkiye will need to give HMRC a guarantee for the provisional duty amount in the form of cash, bond or a bank guarantee. A rate of countervailing amount of 4.42% will apply to imports of the goods from Turkish companies. Please note that importers of goods affected by this measure who wish to provide security for the provisional countervailing duty using a bank guarantee, must apply to HMRC for a general guarantee account.
