Canada: Government of Canada commences an expiry review of certain Seamless Casing from China

On September 18, 2023, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on November 28, 2018, in Expiry Review No. RR-2017-006, concerning the dumping and subsidizing of seamless carbon or alloy steel oil and gas well casing, originating in or exported from China. As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. The CBSA will make a determination no later than February 15, 2024, and will issue a statement of reasons by March 1, 2024.

Canada: Notice of normal value review of Corrosion-resistant steel sheet 2

The Canada Border Services Agency (CBSA) has initiated a normal value review (review) to establish the normal values and export prices applicable to certain corrosion-resistant steel sheet (COR) originating in or exported from Vietnam by Delaware Steel Company, Div. of Consolidated Fabricators Corp. (Delaware).
The review follows a request for re-determination filed by an importer and is part of the CBSA's enforcement of the Canadian International Trade Tribunal's (CITT) finding issued on November 16, 2020 in Inquiry No. NQ-2019-002, respecting the dumping of COR originating in or exported from Türkiye and Vietnam and the subsidizing of such goods, originating in or exported from Türkiye, in accordance with the Special Import Measures Act (SIMA).

Canada: Notice of close of record and updated schedule of Carbon steel fasteners (FAS 2023 UP2)

The Canada Border Services Agency (CBSA) has now closed the record of the normal value review (review) of certain carbon steel fasteners (fasteners) originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) by Industry Building Hardware Co., Ltd. The review is part of the CBSA's enforcement of the Canadian International Trade Tribunal's order issued on September 2, 2020 in Expiry Review No. RR-2019-002, respecting the dumping of fasteners originating in or exported from China and Chinese Taipei, and the subsidizing of such goods originating in or exported from China, excluding fasteners specifically designed for application in the automotive or aerospace industry, in accordance with the Special Import Measures Act (SIMA).

Canada: Notice of conclusion of a re-investigation of Copper pipe fittings (CPF 2023 RI)

The Canada Border Services Agency (CBSA) has concluded a re‑investigation of the normal values and export prices respecting certain copper pipe fittings from the United States, South Korea, and China and amounts of subsidy of copper pipe fittings from China, in accordance with the Special Import Measures Act (SIMA). The re-investigation was initiated on February 15, 2023, as part of the CBSA’s ongoing enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on September 14, 2022.

EU imposed a definitive anti-dumping duty on imports of melamine 

EU has imposed a definitive anti-dumping duty on imports of melamine originating in the People’s Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The product subject to this review is melamine (‘the product under review’), currently falling under CN code 2933 61 00. Melamine is a white crystalline powder produced predominantly from urea and is used mainly for producing laminates, resins, wood adhesives, moulding compounds and paper/textile treatments.

EU: Notice amending the Notice of initiation of an anti-dumping proceeding concerning imports of certain manganese dioxides 

EU has published notice amending the notice of initiation of an anti-dumping proceeding concerning imports of certain manganese dioxides originating in the People’s Republic of China published on 16 February 2023. On 7 September 2023, AUTLAN EMD SL (‘the complainant’) made a request in accordance with Article 7(2a) of the basic Regulation to include the examination of alleged raw material distortions in the country concerned regarding the product under investigation in the above-mentioned anti-dumping proceeding, to assess whether, if relevant, a duty lower than the margin of dumping would be sufficient to remove injury This request was made by the Union industry of certain manganese dioxides in the sense of Article 5(4) of the basic Regulation.

EU: Anti-dumping duty on imports of melamine originating in the People’s Republic of China

The product subject to this review is melamine, currently falling under CN code 2933 61 00. Melamine is a white crystalline powder produced predominantly from urea and is used mainly for producing laminates, resins, wood adhesives, moulding compounds and paper/textile treatments.

EU initiated an investigation concerning possible circumvention of the anti-dumping measures imposed by Implementing Regulation (EU) 2021/1930 on imports of birch plywood 

EU has initiated an investigation concerning possible circumvention of the anti-dumping measures imposed by Implementing Regulation (EU) 2021/1930 on imports of birch plywood originating in Russia, by imports of birch plywood consigned from Türkiye and Kazakhstan, whether or not declared as originating in Türkiye and Kazakhstan and making imports of birch plywood consigned from Türkiye and Kazakhstan subject to registration. The product under investigation is the same as that defined in the previous recital, currently falling under CN code 44123310 but consigned from Türkiye and Kazakhstan, whether declared as originating in Türkiye and Kazakhstan (TARIC codes 4412331010 and 4412331020 (‘the product under investigation’).

EU imposed a definitive anti-dumping duty on imports of certain coated fine paper 

EU has imposed a definitive anti-dumping duty on imports of certain coated fine paper originating in the People's Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The anti-dumping duties currently in force are at rates ranging between 8 % and 35,1 % on imports from the sampled exporting producers, and a duty rate of 27,1 % on all other companies from the PRC.

EU imposed a definitive countervailing duty on imports of certain coated fine paper 

EU has imposed a definitive countervailing duty on imports of certain coated fine paper originating in the People’s Republic of China following an expiry review pursuant to Article 18 of Regulation (EU) 2016/1037 of the European Parliament and of the Council. Product concerned by the expiry review investigation is the product under review originating in China currently falling under CN codes ex 4810 13 00, ex 4810 14 00, ex 4810 19 00, ex 4810 22 00, ex 4810 29 30, ex 4810 29 80, ex 4810 99 10 and ex 4810 99 80 (TARIC codes 4810 13 00 20, 4810 14 00 20, 4810 19 00 20, 4810 22 00 20, 4810 29 30 20, 4810 29 80 20, 4810 99 10 20 and 4810 99 80 20).

EU has initiated an investigation concerning possible circumvention of the countervailing measures imposed by Implementing Regulation (EU) 2019/2092 on imports of biodiesel originating in Indonesia by imports of biodiesel consigned from the People’s Republic of China and the United Kingdom, whether declared as originating in the People’s Republic of China and the United Kingdom or not and making such imports subject to registration. India imposed anti-dumping duty on imports of “Flat base steel wheels”

India customs authority has imposed an anti-dumping duty on import of "Flat base steel wheels" (HTS Code 870870) originating in and exported from China PR for a period of 5 years.

India imposed anti-dumping duty on imports of fishing net

India customs authority has imposed an anti-dumping duty on import of Fishing Net (classified under HTS 56081110) originating in and exported from Malaysia. 

Mexican government imposes temporary import duties of up to 25% on the importation of goods classified in 392 tariff items

On August 15, 2023, the President of Mexico, Andres Manuel Lopez Obrador, published a Decree amending the Tariff Schedule of the General Import and Export Duties Law. The decree focuses on the implementation of temporary import duties ranging between 5% and 25% on goods classified in 392 tariff items covering steel, aluminum, bamboo, rubber, chemical products, oils, soap, paper, cardboard, ceramic products, glass, electrical material, musical instruments and furniture (classified under tariff chapters 28, 34, 39, 40, 48, 49, 52, 54, 55, 61, 62, 63, 64, 65, 68, 69, 70, 71, 72, 73, 74, 75, 76, 82 etc). These temporary duties are applicable as of August 16, 2023 and until July 31, 2025. In addition, the decree eliminates the tariff reduction provided for in the decree published in the Federal Official Gazette on November 18, 2022, arguing that the textile and footwear sectors are facing a situation of vulnerability. In order to prevent affecting the productive supply chains and to maintain the competitiveness of the most sensitive industrial sectors, in the transitory articles of the decree, the Ministry of Economy includes in the electric, electronic and automotive and auto parts sectors of the Sectoral Promotion Program ("PROSEC") certain tariff items corresponding to the steel industry. The inclusion of these products in the PROSEC Program will grant duty reductions which will remain in force from August 16, 2023 and until July 31, 2025.

UK: Update to trade remedies for suspension of anti-dumping duty on certain bicycle parts from China imported by Frog Bikes Limited, update to SPVs and duty suspension footnote update

The UK’s definitive anti-dumping measures on certain bicycle parts from China has been amended. This affects imports by Frog Bikes Limited where the measure is suspended as of 15 September 2023. Impacted products are classified under tariff heading 8714.

UK: Update to Trade Remedies for Imports of Hot Rolled Flat and Coil Steel

Anti-dumping and countervailing measures on imports of Hot Rolled Flat and Coil Steel will remain in place until 2027. The Government has today (Tuesday 29 August) accepted the Trade Remedies Authority’s (TRA) final recommendation to maintain anti-dumping and countervailing measures on imports of Hot Rolled Flat and Coil steel.  Keeping these measures in place until at least 2027 will help to protect the UK’s steel industry from unfair competition, as Hot Rolled Flat and Coil commonly used as a raw material for other types of steel and making up almost a third of all steel production globally. The TRA proposed in March that anti-dumping and countervailing measures on imports from China and anti-dumping measures on imports from Russia, Brazil and Iran be maintained until at least 2027. However, the TRA recommended that anti-dumping measures on imports from Ukraine be revoked, as it concluded that dumping of products from Ukraine was unlikely to recur, due to reduction in Ukraine’s production capacity and limits on the ability to export caused by the war with Russia. The TRA also took into account Ukraine’s requirement to rebuild steel production facilities and domestic demand for steel to rebuild the country’s infrastructure.

UK: Update to trade remedies for ironing boards from Turkey

The United Kingdom’s countervailing measures on ironing boards from Turkey have been made definitive. This will come into effect from 8 September 2023. This update will impact the commodity codes 7323930010; 7323990010; 8516797010; 8516900051. If you are an importer you will need to use additional codes 8B04 or 8B05.

United States: Final Affirmative Determination in the Antidumping Duty Investigation of Gas Powered Pressure Washers from the Socialist Republic of Vietnam

On August 23, 2023, the Department of Commerce (Commerce) announced its affirmative final determination in the antidumping duty (AD) investigation of gas-powered pressure washers (classified under HTS 8424.30.9000) from the Socialist Republic of Vietnam (Vietnam).

United States: Commerce Initiates Antidumping Duty Investigations of Mattresses from Bosnia and Herzegovina, Bulgaria, Burma, India, Italy, Kosovo, Mexico, the Philippines, Poland, Slovenia, Spain, and Taiwan and Countervailing Duty Investigation of Mattresses from Indonesia

On August 18, 2023, the U.S. Department of Commerce (Commerce) announced the initiation of antidumping duty (AD) investigations of mattresses from Bosnia and Herzegovina, Bulgaria, Burma, India, Italy, Kosovo, Mexico, the Philippines, Poland, Slovenia, Spain, and Taiwan and a countervailing duty (CVD) investigation of mattresses from Indonesia. Impacted products are classified under tariff HTS codes 9404.21.0010, 9404.21.0013, 9404.21.0095, 9404.29.1005, 9404.29.1013, 9404.29.1095, 9404.29.9085, 9404.29.9087, and 9404.29.9095.

United States: Preliminary Affirmative Determinations in the Antidumping Duty Investigations of Tin Mill Products from Canada, the People’s Republic of China, and Germany and Preliminary Negative Determinations in the Antidumping Duty Investigations of Tin Mill Products from the Republic of Korea, the Netherlands, Taiwan, the Republic of Turkey, and the United Kingdom

On August 17, Commerce announced the preliminary determinations in the antidumping duty (AD) investigations of tin mill products from Canada, the People’s Republic of China (China), Germany, the Republic of Korea (Korea), the Netherlands, Taiwan, the Republic of Turkey (Turkey), and the United Kingdom. Commerce is conducting a concurrent countervailing duty (CVD) investigation on imports of tin mill products from China. Impacted product is classified under tariff HTS code 7210.11.0000, 7210.12.0000, 7210.50.0020, 7210.50.0090, 7210.50.0000, 7212.10.0000, 7212.50.0000, 7225.99.0090, and 7226.99.0180.
