Canada: Conclusion of normal value review of Carbon steel fasteners

The Canada Border Services Agency (CBSA) has concluded a normal value review (review) to determine normal values and export prices applicable to certain carbon steel fasteners (fasteners) originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) by Zyh Yin Enterprise Co. Ltd (Zyh Yin).

The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on September 2, 2020 in Expiry Review No. RR-2019-002, respecting the dumping of fasteners originating in or exported from the People’s Republic of China (China) and Chinese Taipei, and the subsidizing of such goods, originating in or exported from China, excluding fasteners specifically designed for application in the automotive or aerospace industry, in accordance with the Special Import Measures Act (SIMA).

Canada: Notice of extension of investigations of Container chassis

The Canada Border Services Agency has extended the preliminary phase of the investigations into the alleged injurious dumping and subsidizing of certain container chassis originating in or exported from China.

The Special Import Measures Act (SIMA) provides that, under normal circumstances, the preliminary stage of the investigations shall be completed within 90 days of the date of initiation. However, due to the existence of circumstances that, in the opinion of the CBSA, make it unusually difficult to decide within ninety days whether to make preliminary determinations or to terminate the investigations with respect to some or all of the goods, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA.

China: Announcement on the Preliminary Ruling of Anti-dumping Investigation into Imports of Polyphenylene

In accordance with the Anti-dumping Regulations of the People's Republic of China, on August 3, 2020, the Ministry of Commerce of the People's Republic of China issued Announcement deciding to carry out anti-dumping investigation into Imports of Polyphenylene ether Originating in the United States. The Investigation Authority has preliminarily affirmed dumping of Imports of Polyphenylene ether Originating in the United States, substantial damage to China's domestic Polyphenylene ether industry and the causal relationship between the dumping and the substantial damage. The Investigation Authority has decided to carry out the interim anti-dumping measures by levying deposit according to Article 28 and Article 29 of the Anti-dumping Regulations. As of September 7, 2021, importers shall pay the relevant deposit to the Customs of the People's Republic of China at the rate determined by this ruling for each company (18.3% for SABIC Innovative Plastics US LLC and 48.6% for the rest of manufacturers) when importing the Products under Investigation.

A China Customs notice was concurrently published to spread corresponding CN HTS to ten digits and normalize the declared commodity description in customs declaration. The CN HTS of "poly2, 6-dimethyl-1, 4-phenyl ether (including chemically modified or physically modified)" should be declared in 39072090.10, and the one for "other polyethers of primary shape" should be in 39072090.90.

China: Announcement on the Preliminary Ruling of Anti-dumping Investigation into Imports of Certain monoalkyl ethers of ethylene glycol and propylene glycol

The Ministry of Commerce of the People's Republic of China (MOFCOM) released MOFCOM Announcement No. 36 of 2020 and decided to file Anti-dumping investigation into imports of Certain monoalkyl ethers of ethylene glycol and propylene glycol Originating in the US according to the relevant provisions of the Regulations of the People's Republic of China on Anti-dumping.

The Investigation Authority has decided to carry out the interim anti-dumping measures by levying deposit according to Article 28 and Article 29 of the Anti-dumping Regulations. As of September 11, 2021, importers shall pay the relevant deposit to the Customs of the People's Republic of China at the rate determined by this ruling for each company (57.4% for The Dow Chemical Company and 65.4% for the rest of manufacturers when importing the Products under Investigation.

A China Customs notice was concurrently published to spread corresponding CN HTS to ten digits and normalize the declared commodity description in customs declaration. Declaration by the consignee or the agent for imports of ethylene glycol or other monoalkyl ethers of diethylene glycol (CN HTS 29094400), should fill in 29094400.10 for ethylene glycol methyl ether, diethylene glycol methyl ether, ethylene glycol diethyl ether, ethylene glycol propyl ether, ethylene glycol propyl ether, ethylene glycol hexane ether, ethylene glycol iso-octyl ether, and ethylene glycol iso-octyl ether. Fill in 29094400.90 for other monoalkyl ethers of ethylene glycol. Declaration by the consignee or his agent for imports of other alcohol ethers and their halogenated, sulfonated, nitrated or nitrated derivatives (CN HTS 29094990),  should fill in 29094990.10 for triethylene glycol ether, tetraethylene glycol ether, triethylene glycol ether, propylene glycol ether, dipropylene glycol ethyl ether, propylene glycol propyl ether, dipropylene glycol propyl ether, propylene glycol propyl ether, propylene glycol butyl ether, dipropylene glycol butyl ether, tripropylene glycol butyl ether. Fill in 29094990.90 for other propylene glycol should be filled in.

China: Announcement on the Preliminary Ruling of Countervailing Investigation into Imports of Certain monoalkyl ethers of ethylene glycol and propylene glycol

In accordance with the Regulations of the People's Republic of China on Countervailing Measures, on September 14,2020, the Ministry of Commerce of the People's Republic of China issued Announcement No.37 of 2020, deciding to carry out countervailing investigation into imports of Certain monoalkyl ethers of ethylene glycol and propylene glycol originating in the US.

The Investigation Authority has preliminarily affirmed countervailing measures of imports of Certain monoalkyl ethers of ethylene glycol and propylene glycol originating in the US, substantial damage to China's domestic Monoalkyl ethers for ethylene glycol and propylene glycol industry and the causal relationship between the countervailing measures and the substantial damage. Nevertheless the announcement also states in view of the circumstances, MOFCOM decided to suspend provisional countervailing duty measures on imports of Certain monoalkyl ethers of ethylene glycol and propylene glycol imported from the United States.

China: Announcement on the Final Ruling of Anti-dumping Investigation into Imports of Polyvinyl Chloride

The Ministry of Commerce of the People's Republic of China (MOFCOM) released MOFCOM Announcement No. 40 of 2020 and decided to file anti-dumping investigation into imports of Polyvinyl Chloride originating in the United States according to the relevant provisions of the Regulations of the People's Republic of China on anti-dumping. Based on the findings of the investigation and the provisions of Article 24 of the Regulations of the People's Republic of China on anti-dumping, the investigating authority makes the determination. The investigation authorities found that imports of PVC from the United States were dumped but there was no material injury or threat China's PVC industry. In accordance with article 27 of the Regulations of the People's Republic of China on anti-dumping, the investigating authorities have decided to terminate the anti-dumping investigation against imports of PVC from the United States as of the date of this announcement. 

China: Announcement on the Final Ruling of Countervailing Investigation into Imports of Polyvinyl Chloride

In accordance with the Countervailing Regulations of the People's Republic of China, MOFCOM issued Announcement No. 41 on October 14, 2020, deciding to initiate an countervailing investigation against Polyvinyl Chloride imported from the United States. Based on the findings of the investigation and article 25 of the Countervailing Regulations of the People's Republic of China, the investigating authority made the determination. The investigation authorities found that there were countervailing for imported PVC from the United States, but China's PVC industry had not suffered material injury or threat.  In accordance with article 28 of the Countervailing Regulations of the People's Republic of China, the investigation authorities have decided to terminate the countervailing investigation against Polyvinyl Chloride imported from the United States as of Sep 23,2021.

European Union: extending the definitive anti-dumping duty on imports of certain aluminium foil in rolls (small rolls)

Per EU Commission implementing regulation 2021/1475, EU has extended the definitive anti-dumping duty on imports of certain aluminium foil in rolls originating in the People’s Republic of China to imports of certain aluminium foil in rolls consigned from Thailand, whether declared as originating in Thailand or not. The product under investigation is the same as that defined in the previous recital, currently falling under CN codes ex 7607 11 11 and ex 7607 19 10, but consigned from Thailand, whether declared as originating in Thailand or not (TARIC codes 7607 11 11 11 and 7607 19 10 11) (‘the product under investigation’).

European Union: extending the definitive anti-dumping duty on imports of certain aluminium foil in rolls (jumbo rolls)

Per EU Commission implementing regulation 2021/1474, EU has extended extending the definitive anti-dumping duty imposed by Implementing Regulation (EU) 2015/2384 and Implementing Regulation (EU) 2017/271 on imports of certain aluminium foil originating in the People’s Republic of China to imports of certain aluminium foil consigned from Thailand, whether declared as originating in Thailand or not. The product under investigation is the same as that defined in the preceding recital, currently falling under CN codes ex 7607 11 19 (TARIC codes 7607 11 19 10, 7607 11 19 30, 7607 11 19 40, 7607 11 19 50) and ex 7607 11 90 (TARIC codes 7607 11 90 44, 7607 11 90 46, 7607 11 90 71, 7607 11 90 72), but consigned from Thailand, whether declared as originating in Thailand or not (TARIC additional code C601), (‘the product under investigation’).

European Union: extending the definitive anti-dumping duty on imports of stainless-steel cold-rolled flat products

Per EU Commission implementing regulation 2021/1483, EU has extended imposing a definitive anti-dumping duty on imports of stainless-steel cold-rolled flat products originating in the People’s Republic of China and Taiwan following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The product under review is the same as in the original investigation, namely flat-rolled products of stainless steel, not further worked than cold-rolled (cold-reduced), currently falling under CN codes 7219 31 00, 7219 32 10, 7219 32 90, 7219 33 10, 7219 33 90, 7219 34 10, 7219 34 90, 7219 35 10, 7219 35 90, 7219 90 20, 7219 90 80, 7220 20 21, 7220 20 29, 7220 20 41, 7220 20 49, 7220 20 81, 7220 20 89, 7220 90 20 and 7220 90 80 (‘product under review’ or ‘SSCR’).

European Union: Notice of initiation of a partial interim review of the countervailing measures applicable to imports of certain rainbow trout

Per EU Commission implementing regulation (2021/C 380/05) EU has issued notice of initiation of a partial interim review of the countervailing measures applicable to imports of certain rainbow trout originating in the Republic of Turkey. Products currently falling under CN codes ex 0301 91 90, ex 0302 11 80, ex 0303 14 90, ex 0304 42 90, ex 0304 82 90 and ex 0305 43 00 (TARIC codes 0301 91 90 11, 0302 11 80 11, 0303 14 90 11, 0304 42 90 10, 0304 82 90 10 and 0305 43 00 11) (‘product under review’).

European Union: Notice of initiation of an anti-dumping proceeding concerning imports of electrolytic chromium coated steel (ECCS)

EU has issued notice of initiation of an anti-dumping proceeding concerning imports of electrolytic chromium coated steel (ECCS) products originating in the People’s Republic of China and Brazil. The product allegedly being dumped is the product under investigation, originating in the People’s Republic of China and Brazil (‘the countries concerned’), currently classified under CN codes 7210 50 00 and 7212 50 20.
