Canada: Notice of normal value review of Carbon steel fasteners

The Canada Border Services Agency (CBSA) has today initiated a normal value review (review) to determine the normal values and export prices applicable to certain carbon steel fasteners (fasteners) originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) by Honor Best Co., Ltd.  The review follows the receipt of a request for re‑determination by an importer in Canada and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on September 2, 2020 in Expiry Review No. RR‑2019‑002, respecting the dumping of fasteners originating in or exported from the People’s Republic of China (China) and the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) and the subsidizing of such goods, originating in or exported from China, excluding fasteners specifically designed for application in the automotive or aerospace industry, in accordance with the Special Import Measures Act (SIMA).

Please be advised that exporters who are not the manufacturers of the subject goods should ensure that their suppliers/manufacturers have received the RFI and that they also provide a complete and accurate response to the RFI by December 13, 2021.

Canada: Notice of close of record and updated schedule of Concrete reinforcing bar

The Canada Border Services Agency (CBSA) has now closed the record of the normal value review of certain concrete reinforcing bar (rebar) exported to Canada from Turkey by Kaptan Demir Celik Endustrisi ve Ticaret A.S. (Kaptan).

The normal value review is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) ) order issued on October 14, 2020, respecting the dumping of certain concrete reinforcing bar from China, Korea, and Turkey and the subsidizing of certain concrete reinforcing bar originating in or exported from China, in accordance with the Special Import Measures Act (SIMA).

The updated schedule for this normal value review is now available. Interested parties will now have seven days from the close of the record to file submissions concerning this review.

Canada: Notice of preliminary determination of Oil country tubular goods

The Canada Border Services Agency (CBSA), pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), made a preliminary determination of dumping respecting certain oil country tubular goods from Austria. The subject goods are usually classified under the tariff classification numbers:

China: Announcement on Ruling on Expiry Review of Anti-dumping Measures against Imports of Polyamide-6,6 Originating in USA

MOFCOM released MOFCOM Announcement No. 79 of 2009 on Oct 12,2009 and decided to implement the anti-dumping measures against imports of Polyamide-6,6 originating in the USA, Italy, Britain, France and Taiwan for five years starting from Oct 13, 2009; and in MOFCOM Announcement No. 37 of 2015 decided to continue to impose anti-dumping duty on imports of polyamide-6,6 from the USA, Italy, France and Taiwan starting from October 13, 2015 for a another period of 5 years. The anti-dumping measures on imports polyamide-6,6 originating in the United Kingdom shall expire.

MOFCOM released MOFCOM Announcement No. 42 of 2020 on Oct 12,2020 and decided to carry out expiry review investigation into the above applicable anti-dumping measures in the meanwhile announced measures on imports of Polyamide-6,6 from Italy, France and Taiwan are terminated.

MOFCOM has investigated and ruled that the dumping of imports of polyamide-6,6 originating in the USA may continue or occur again in the Mainland of China and it may continue to cause damage or may again cause damage to the polyamide-6,6 industry of the Mainland of China if the anti-dumping measures are terminated.

In accordance with Article 50 of the Anti-dumping Regulations and the investigation results, MOFCOM suggested continuing to implement the anti-dumping measures to the Customs Tariff Commission of the State Council. According to the suggestion of MOFCOM, the Customs Tariff Commission of the State Council then decided to continue to impose anti-dumping duties on imports of Polyamide-6,6 originating in the USA for five years starting from Oct 13, 2021.

China: Announcement on the Preliminary Ruling of Countervailing Investigation into Imports of Polyphenylene ether Originating in the US

On August 14, 2020, the Ministry of Commerce of the People's Republic of China (MOFCOM) released MOFCOM Announcement No. 32 of 2020 and decided to file countervailing investigation into imports of Polyphenylene ether originating in the US according to the relevant provisions of the Regulations of the People's Republic of China on countervailing.

The Investigation Authority has preliminarily affirmed countervailing measures of imports of Polyphenylene ether originating in the US, substantial damage to China's domestic Polyphenylene ether industry and the causal relationship between the countervailing measures and the substantial damage.

The Investigation Authority has decided to carry out the interim anti- countervailing measures by levying margin according to Article 29 and Article 30 of the Regulations of the People's Republic of China on Countervailing Measures. As of Oct 15, 2021, importers shall pay the relevant deposit to the Customs of the People's Republic of China at the rate determined by this ruling for all company (range at 17.7%) when importing the Products under Investigation.

India imposed anti-dumping duty on Seamless tubes, pipes and hollow profiles of iron

Per CBIC Notification No. 64/2021-Customs (ADD) India seeks to impose anti-dumping duty on 'Seamless tubes, pipes and hollow profiles of iron, alloy or non-alloy steel (other than cast iron and stainless steel), whether hot finished or cold drawn or cold rolled of an external diameter not exceeding 355.6 mm or 14" OD' (Classified under tariff headings 7304) originating in or exported from China PR for a period of 5 years.

India seeks to remove levy of ADD on Polytetrafluoroethylene

Per CBIC Notification No. 63/2021-Customs (ADD) India seeks to rescind Notification No. 24/2021-Customs (ADD) dated 26th April, 2021, to remove levy of ADD on Polytetrafluoroethylene (Classified under tariff code 39046100) originating in or imported from Korea RP.

Per CBIC Notification No. 62 /2021-Customs (ADD) India seeks to rescind Notification No. 23/2016-Customs (ADD) dated 6th June, 2016, to remove levy of ADD on Polytetrafluoroethylene (Classified under tariff code 39046100) originating in or imported from Russia.

India seeks to remove levying ADD on Phenol

Per CBIC Notification No. 61 /2021-Customs (ADD) India seeks to rescind Notification No. 06/2016-Customs (ADD) levying ADD on Phenol (falling under tariff item 29071110) originating and imported from European Union, Singapore and Korea RP.

India imposed anti-dumping duty on Aceto Acetyl Derivatives of aromatic or hetrocyclic compounds

Per CBIC Notification No. 60 /2021-Customs (ADD) India seeks to levy of ADD on “Aceto Acetyl Derivatives of aromatic or hetrocyclic compounds also known as Arylides” (falling under tariff items 2924 29 20 or 2924 29 90) originating in or imported from China PR.

India extend anti-dumping duty on 'ceramic tableware and glassware'

Per CBIC Notification No. 59 /2021-Customs (ADD) India seeks to extend anti-dumping duty on 'ceramic tableware and glassware' (falling under the heading 6911 and 6912) originating in or exported from Malaysia, to prevent the circumvention of anti-dumping duty levied on subject goods originating in or exported from China PR vide Notification No. 4/2018-Customs (ADD) dated 21st February, 2018.
