Australia extends anti-dumping duties on steel pallet racking produced 

Australia has decided to extend anti-dumping duties on steel pallet racking produced in China and Malaysia. (HS:7308.90.00).

Canada has started an investigation into anti-dumping duties and countervailing duties on high protein content pea protein produced in China

The Canada Border Services Agency (CBSA) initiated investigations on April 22, 2024, under the Special Import Measures Act respecting the alleged injurious dumping and subsidizing of certain pea protein from China. The investigations follow a complaint filed by Nutri-Pea GP Inc. and Roquette Canada Ltd. (collectively “the complainants”) (Portage La Prairie, MB). The subject goods are usually classified under the following tariff classification numbers: 3504.00.90.00 and 2106.10.00.00. These tariff numbers may also include non-subject goods, and subject goods may also fall under additional tariff numbers.

Canada: Notice of normal value review of Carbon Steel Welded Pipe (CSWP1 2024 UP1)

The Canada Border Services Agency (CBSA) has initiated a normal value review (review) to establish the normal values, export prices and amounts of subsidy applicable to carbon steel welded pipe (CSWP) originating in or exported from China by Tianjin Baode Steel Co., Ltd. The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on March 28, 2019 in Expiry Review No. RR-2018-001, respecting the dumping and subsidizing of CSWP originating in or exported from China, in accordance with the Special Import Measures Act (SIMA). Should the exporter decide to participate in this review, it is required to provide a complete and accurate response to the CBSA’s dumping request for information (RFI) and subsidy RFI by May 22, 2024, by 5 p.m. ET. The exporter will be considered co-operative if the requested information is complete, submitted on time and the exporter permits verification of the data.

Please be advised that exporters who are not the manufacturers of the subject goods (i.e., trading company, vendor, etc.) should ensure that their suppliers/manufacturers have received the dumping RFI and subsidy RFI and that they also provide complete and accurate responses to the two RFIs by May 22, 2024, by 5 p.m. ET.

Canada: Notice of conclusion of expiry review investigation of Cold-rolled steel (CRS 2023 ER)

The Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on December 21, 2018, in Inquiry No. NQ-2018-002, concerning the dumping and subsidizing of certain cold-rolled steel originating in or exported from China, South Korea and Vietnam. As a result, on November 15, 2023, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the finding is likely to result in the continuation or resumption of dumping and subsidizing of certain certain cold-rolled steel originating in or exported from China, South Korea and Vietnam. A Statement of Reasons that contains additional details concerning the determination made by the CBSA will be issued within 15 days. The CITT will now conduct an inquiry to determine whether the expiry of its finding is likely to result in injury to the Canadian industry and has announced that it will issue its decision no later than September 19, 2024. Canada: Notice of normal value review of Upholstered Domestic Seating (UDS 2024 UP3)

The Canada Border Services Agency (CBSA) has initiated a normal value review (review) to establish the normal values, export prices and amounts of subsidy applicable to upholstered domestic seating (UDS) originating in or exported from Vietnam by Duc Thanh Co., Ltd. The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) finding issued on September 2, 2021 in Inquiry No. NQ-2021-002, respecting the dumping and subsidizing of UDS originating in or exported from China and Vietnam, in accordance with the Special Import Measures Act (SIMA). The product definition and the applicable tariff classification numbers of the goods subject (subject goods) to the CITT’s finding can be found on the CBSA’s Measures in force. Should the exporter decide to participate in this review, it is required to provide a complete and accurate response to the CBSA’s dumping request for information (RFI) and subsidy RFI by May 9, 2024, by 5 p.m. ET. EU imposed a provisional anti-dumping duty on imports of certain alkyl phosphate esters originating in the People’s Republic of China

Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (‘the basic Regulation’), and in particular Article 7 thereof, imposing a provisional anti-dumping duty on imports of certain alkyl phosphate esters originating in the People’s Republic of China. The product under investigation is certain alkyl phosphate esters (‘APE’), currently classified under CN code ex 2919 90 00 (TARIC codes 2919900050 and 2919900065) and CN code ex 3824 99 92 (TARIC code 3824999238) (‘the product under investigation’).

EU has launched an investigation into countervailing tariffs on mobile access equipment 

The EU has launched an investigation into countervailing tariffs on mobile access equipment produced in China. (CN: 8427 10 10, 8427 20 19, 8428 90 90, 8431 20 00, 8431 39 00) (TARIC code: 8427 10 10 10, 8427 20 19 10, 8428 90 90 20, 8431 20 00 60, 8431 39 00 10).

EU has published notice of initiation of an expiry review of the anti-dumping measures applicable to imports of certain tubes and pipes fittings, originating in the Federation of Russia, the Republic of Korea and Malaysia

The request was submitted on 11 January 2024 by the Defence Committee of the steel butt-welding fittings industry of the European Union, ('the applicant') on behalf of the Union industry of certain tubes and pipe fittings, in the sense of Article 5(4) of the basic Regulation. An open version of the request and the analysis of the degree of support by Union producers for the request are available in the file for inspection by interested parties. Section 5.6 of this Notice provides information about access to the file for interested parties. The product subject to this review is tube or pipe fittings (other than cast fittings, flanges and threaded fittings), of iron or steel (not including stainless steel), with a greatest external diameter not exceeding 609,6 mm, of a kind used for buttwelding or other purposes, currently falling under CN codes ex 7307 93 11, ex 7307 93 19 and ex 7307 99 80 (TARIC codes 7307 93 11 91, 7307 93 11 93, 7307 93 11 94, 7307 93 11 95, 7307 93 11 99, 7307 93 19 91, 7307 93 19 93, 7307 93 19 94, 7307 93 19 95, 7307 93 19 99, 7307 99 80 92, 7307 99 80 93, 7307 99 80 94, 7307 99 80 95 and 7307 99 80 98). EU imposing a definitive anti-dumping duty on imports of certain polyethylene terephthalate originating in People’s Republic of China

Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union and in particular Article 9(4) thereof, EU imposed a definitive anti-dumping duty on imports of certain polyethylene terephthalate originating in People’s Republic of China.

EU notice of initiation of an anti-subsidy proceeding concerning imports of mobile access equipment (‘MAE’), originating in the People’s Republic of China 

The product subject to this investigation is mobile access equipment designed for the lifting of persons, self-propelled, with a maximum working height of 6 meters or more, and pre-assembled or ready-to-assemble sections thereof, excluding individual components when presented separately, and excluding person lifting equipment mounted on vehicles of Chapter 86 and Chapter 87 of the Harmonised System (‘the product under investigation’). All interested parties wishing to submit information on the product scope must do so within 10 days of the date of publication of this Notice. The product allegedly being subsidised is the product under investigation, originating in the People’s Republic of China (‘the country concerned’), currently classified, for the MAE, under CN codes ex 8427 10 10, ex 8427 20 19, ex 8428 90 90 and, for the pre-assembled or ready-to-assemble sections of MAE, under ex 8431 20 00 and ex 8431 39 00 (TARIC codes:8427 10 10 10, 8427 20 19 10, 8428 90 90 20, 8431 20 00 60 and 8431 39 00 10). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification. 

EU Commission protects EU industry from PET plastic dumping for next five years

The European Commission has imposed definitive anti-dumping duties on imports of certain polyethylene terephthalate (‘PET’) from China, defending EU companies and more than 1,500 jobs. The EU market of PET has a value of over €5.5 billion. The Commission confirmed the provisional duties that were imposed on 27 November 2023, ranging from 6.6% to 24.2% depending on the exporting producer. These duties will be in place for a period of five years. The duties come as the result of an EU investigation which found that dumping of Chinese imports presented a threat of a clearly foreseeable and imminent injury to EU industry. It showed that the influx of dumped Chinese imports at artificially low prices was undercutting EU industry’s prices, forcing the EU industry to reduce its prices to such a low level that they were selling their products at a loss. PET is used predominantly to produce plastic bottles and is fully recyclable. The impact of the duties on EU consumers of PET was found to be minimal.

India extended anti-dumping duty on Aluminium Road Wheels imported from China PR.

In  the  matter  of  continuation  of  anti-dumping duty on imports of “Cast Aluminium Alloy Wheels or Alloy Road Wheels (ARW) used in Motor Vehicles, whether or not attached with their  accessories, of a size in diameters ranging from 12 inches to 24 inches” (hereinafter referred to as the subject goods) falling under sub-heading 8708 70 of the First Schedule to the Customs Tariff Act, originating in or exported from China  PR (hereinafter referred to as the subject country), imposed vide notification of the Government of India, Ministry of Finance (Department of Revenue), number 17/2019 - Customs (ADD), dated the 9th April, 2019, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 296(E), dated the 9th April, 2019; And whereas, in the matter of review of anti-dumping duty on imports of the subject goods, originating in or exported from the subject country, the designated authority in its final findings, published vide notification number 7/13/2023 - DGTR, dated the 6th January, 2024, published in the Gazette of India, Extraordinary, Part-I, Section 1, dated the 6th January, 2024, has come to the conclusion that - (i) the subject goods continue to be exported to India at prices below the normal value, resulting into dumping of the subject goods; (ii) dumped imports from subject country are causing injury to the domestic industry;(iii)there is likelihood of continuation of dumping and consequent injury to the Indian industry in the event of cessation of the existing anti-dumping duties at this stage, and has recommended continued imposition of the anti-dumping duty on imports of the subject goods, originating in or exported from the subject country, in order to remove injury to the domestic industry.

Trade Remedies Authority have recommended an extension to the anti-dumping duty on certain cast iron articles from China. Update to Commodity Code Structure to maintain dynamic alignment with the EU.   The following commodity codes have been created as of 3 April 2024: 3907610010 and 3907610090.

United Kingdom: Update to Anti-Dumping Duty on Electric Bicycle products from China.

This update is due to the Department for Business and Trade correcting a missing tariff dataset entry in respect of anti-dumping duty on Electric Bicycle products (classified under tariff headings 8711) from China.

United Kingdom: Update to Anti-Dumping Duty on certain bicycle parts from China

Trade Remedies Authority have introduced an exemption from the definitive anti-dumping duty measure on certain bicycles parts (classified under tariff headings 8714) from China imported by Winlong Garments Ltd.

United States: Final Determinations in the Antidumping Duty Investigations of Boltless Steel Shelving from Five Trading Partners

On April 15, 2024, the Department of Commerce (Commerce) announced its final determinations in the antidumping duty (AD) investigations of boltless steel shelving (Classified under HTS subheading 9403.20.0075) from India, Malaysia, Taiwan, Thailand, and the Socialist Republic of Vietnam (Vietnam).

United States: Final Affirmative Determinations in the Antidumping and Countervailing Duty Investigations of Non-Refillable Steel Cylinders 

On April 16, 2024, the Department of Commerce (Commerce) announced its final determinations in the antidumping duty (AD) and countervailing duty (CVD) investigations of non-refillable steel cylinders from India. Product subject to anti-dumping duty is classified under tariff HTS code 7311.00.0060.

United States: Final Determinations in the Antidumping and Countervailing Duty Investigations of Brass Rod 

On April 16, Commerce announced the final determinations in the antidumping duty (AD) investigations of brass rod from Brazil, India, Mexico, South Africa, and the Republic of Korea (Korea). Commerce also announced the final determination in the countervailing duty (CVD) investigation of brass rod from Korea. Product subject to anti-dumping duty is classified under tariff HTS codes 7407.21.1500, 7407.21.7000, and 7407.21.9000.

United States: Antidumping Duty Investigation of Ferrosilicon from the Russian Federation

On April 17, 2024, the U.S. Department of Commerce (Commerce) initiated an antidumping duty investigation to determine whether ferrosilicon from the Russian Federation (Russia) is being sold in the United States at less than fair value. In advance of the issuance of the antidumping duty questionnaire, Commerce asks that you respond to the questions in Attachment I to this letter, requesting information on the quantity and U.S. dollar sales value of all your sales to the United States during the period of investigation July 1, 2023, through December 31, 2023, covered by the scope of this investigation, produced in Russia. The scope of the investigation is included in Attachment II to this letter, and general instructions for responding to this letter are contained in Attachment III. Your receipt of this letter does not indicate that you will be chosen as a mandatory respondent because Commerce may find it is necessary to limit individual examination of respondents and conduct respondent selection under section 777A(c)(2) of the Tariff Act of 1930, as amended (the Act). Also, your receipt of this letter does not guarantee separate rate status. Your response to this letter may be subject to on-site verification by Commerce officials.

United States: Preliminary Determinations in the Countervailing Duty Investigations of Frozen Warmwater Shrimp from Ecuador, India, Indonesia, and the Socialist Republic of Vietnam

On March 26, 2024, the U.S. Department of Commerce (Commerce) announced its preliminary affirmative determinations in the countervailing duty (CVD) investigations of frozen warmwater shrimp (shrimp) from Ecuador, India, and the Socialist Republic of Vietnam (Vietnam) and its preliminary negative determination in the CVD investigation of shrimp from Indonesia. Commerce is conducting concurrent antidumping duty (AD) investigations of shrimp from Ecuador and Indonesia.
