Canada: Notice of initiation of expiry review investigation of Carbon Steel Welded Pipe 3 

On December 11, 2023, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on February 15, 2019, in Inquiry No. NQ-2018-003, concerning the dumping of certain carbon steel welded pipe originating in or exported from Pakistan, the Philippines, Türkiye and Vietnam. As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the finding is likely to result in the continuation or resumption of dumping of the subject goods. The CBSA will make a determination no later than May 9, 2024, and will issue a Statement of Reasons by May 24, 2024. The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s finding (subject goods) can be found on the CBSA’s Measures in force.

As part of its expiry review investigation, the CBSA has solicited responses to questionnaires from Canadian producers, importers and exporters. Any Canadian producers, importers or exporters who have not received a letter from the CBSA who wish to provide a response to the questionnaire are advised to contact the CBSA SIMA Registry and Disclosure Unit by email. Responses to all questionnaires are due at the CBSA SIMA Registry and Disclosure Unit’s email address by January 18, 2024.

Canada notice of normal value review of Hot-rolled carbon steel plate 

The Canada Border Services Agency (CBSA) has concluded a normal value review (review) to update normal values and export prices of hot-rolled carbon steel plate and high-strength low-alloy steel plate exported to Canada from South Korea by Dongkuk Steel Mill Co., Ltd. (Dongkuk). The review is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) injury finding issued on March 13, 2020, in Expiry Review No. RR 2019 001, respecting the dumping of certain hot-rolled carbon steel plate from Brazil, Denmark, Indonesia, Italy, Japan, and South Korea, in accordance with the Special Import Measures Act (SIMA). Beginning January 1, 2022, under the revised customs tariff schedule, subject goods are normally classified under the tariff subheading :720851 and 720852.

Canada notice of close of record and updated schedule of Hollow structural sections

The Canada Border Services Agency has now closed the record of the expedited review of certain hollow structural sections (HSS) exported to Canada from South Korea by Histeel Co., Ltd. This expedited review is part of the ongoing enforcement of the Canadian International Trade Tribunal’s finding of material injury issued on December 23, 2003, respecting the dumping of HSS from South Korea and Türkiye. The finding was subsequently reviewed and continued by orders dated December 22, 2008, December 20, 2013, and October 16, 2019.

China: Announcement on the Final Review of the Anti-dumping Measures against Imports of Acrylonitrile-butadiene rubber

On November 8, 2018, the Ministry of Commerce of the People's Republic of China (MOFCOM) issued the MOFCOM Announcement No.84 of 2018, deciding to impose anti-dumping duty on imports of Acrylonitrile-butadiene rubber (NBR)Originating in Korea and Japan. Currently, duty rates 12.0%—37.3% for Korean companies, 16.0%—56.4 for Japanese companies, and the implementation period is 5 years. On September 8, 2023, the MOFCOM received a formal application for expiry review on anti-dumping measures officially submitted by representatives from NBR industry and claim if the anti-dumping measures is terminated, the dumping behavior and injury to the industry in China might continue or reoccur and requested the MOFCOM to maintain the anti-dumping measures. In accordance with the Anti-dumping Regulations of the People's Republic of China, the MOFCOM conduct review process. Current evidence shows that the applicants meet the provisions specified in Article 11, Article 13 and Article 17 of the Anti-dumping Regulations of the People's Republic of China on industry and industry representative, and therefore, they are eligible for the submission. The investigation authority believes that the applicants' claim and the prima facie evidence submitted are in conformity with the requirements for an expiry review. According to Article 48 of the Anti-dumping Regulations of the People's Republic of China, the MOFCOM decides to conduct an expiry review investigation. This investigation starts from November 9, 2023 and ends prior to November 9, 2024. As suggested by the MOFCOM and decided by the Customs Tariff Commission of the State Council, during the expiry review investigation of the anti-dumping measures, the imports of Hydriodic Acid Originating in Japan and United States will still be subject to anti-dumping duties at the scope and rate released in MOFCOM Announcement No. 84 of 2018 and No. 12 of 2022.

European Union: Notice of initiation of an anti-dumping proceeding concerning imports of optical fibre cables originating in India

The product allegedly being dumped is the product under investigation, originating in India, currently classified under CN code ex 8544 70 00 (TARIC codes 8544700010 and 8544700091).
The product subject to this investigation is single mode optical fibre cables, made up of one or more individually sheathed fibres, with protective casing, whether or not containing electric conductors, whether or not connectorized. The following products are excluded:

  • cables below 500 meters in length in which all the optical fibres are individually fitted with operational connectors at one or both extremities; and
  • cables for submarine use, plastic insulated, containing a copper or aluminium conductor, in which fibres are contained in metal module(s)


European Union: European Commission acts to protect EU industry from PET plastic dumping

The Commission has imposed provisional anti-dumping duties on imports of certain polyethylene terephthalate (‘PET’) plastic products from China, defending EU companies and more than 1,500 jobs. The EU market of PET has a value of over €5.5 billion. PET plastic products from China will now be subject to duties ranging from 6.6% to 24.2%, depending on the exporting producer. These duties will be in place for a maximum period of six months, during which all interested parties can provide feedback, before the Commission, after consulting EU Member States, takes the final decision on the imposition of definitive (i.e. permanent) measures. The duties are the result of an EU investigation which provisionally found that the dumping of Chinese imports presented a threat of a clearly foreseeable and imminent injury to EU industry. It showed that the influx of dumped Chinese imports at artificially low prices was undercutting EU industry’s prices, forcing the EU industry to lower its prices to such a low level that they were selling their products at a loss.

EU has published notice of initiation of a partial interim review of the anti-dumping measures applicable to imports of certain pneumatic tyres, new or retreaded, of rubber, of a kind used for buses or lorries and with a load index exceeding 121 originating in the People’s Republic of China. The product subject to this review is certain pneumatic tyres, new or retreaded, of rubber, of a kind used for buses or lorries, with a load index exceeding 121 (‘the product under review’). The product concerned by this review is the product under review originating in the People’s Republic of China (‘the PRC’ or ‘the country concerned’), currently falling under CN codes 4011 20 90 and ex 4012 12 00 (TARIC code 4012 12 00 10). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification.

European Union: imposed a definitive anti-dumping duty on imports of trichloroisocyanuric acid 

EU has imposed a definitive anti-dumping duty on imports of trichloroisocyanuric acid originating in the People’s Republic of China following an expiry review pursuant to Article 11(2) of the Regulation (EU) 2016/1036 of the European Parliament and of the Council. The product under review is trichloroisocyanuric acid and preparations thereof, also referred to under the international non-proprietary name (INN) ‘symclosene’. The product concerned by the expiry review investigation is the product under review originating in the PRC currently falling under CN codes ex 2933 69 80 and ex 3808 94 20 (TARIC codes 2933698070 and 3808942020).

European Union: EU accepting a request for new exporting producer treatment with regard to the definitive antidumping measures imposed on imports of electric bicycles originating

EU has accepted a request for new exporting producer treatment with regard to the definitive antidumping measures imposed on imports of electric bicycles originating in the People’s Republic of China and amending Implementing Regulation (EU) 2019/73. The company Shenzhen Kinoway Electronic Co., Ltd (‘the applicant’) submitted a request to the Commission to be granted new exporting producer treatment and hence be subject to the duty rate applicable to the cooperating companies in the PRC not included in the sample, i.e. 16,2 % (‘NEPT’), claiming that it met all three conditions set out in Article 1, paragraph 6 of the original Regulation.

European Union: EU imposed a definitive anti-dumping duty on imports of certain hot-rolled flat products of iron, nonalloy or other alloy steel 

EU has imposed a definitive anti-dumping duty on imports of certain hot-rolled flat products of iron, nonalloy or other alloy steel originating in the Federative Republic of Brazil, the Islamic Republic of Iran and the Russian Federation following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The anti-dumping measures currently in force, and which are subject to this expiry review investigation, are hence those applicable to imports from Brazil, Iran and Russia (‘the countries concerned’). The measures are imposed in the form of a fixed duty per tonne and the duty rates range between 54,50 and 63,00 EUR/tonne for Brazil, 57,50 EUR/tonne for Iran and between 17,60 and 96,50 EUR/tonne for Russia.

European Union: EU amending Implementing Regulation (EU) 2023/1776 imposing a definitive anti-dumping duty on imports of melamine 

EU has amended Regulation (EU) 2023/1776 imposing a definitive anti-dumping duty on imports of melamine originating in the People’s Republic of China following a ‘new exporter’ review pursuant to Article 11(4) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The product under review is melamine currently falling under CN code 2933 61 00, originating in the PRC. Melamine is a white crystalline powder produced predominantly from urea and is used mainly for producing laminates, resins, wood adhesives, moulding compounds and paper/textile treatments.

India imposed anti-dumping duty on Synthetic Grade Zeolite 4A 

India customs authority has imposed anti-dumping duty on Synthetic Grade Zeolite 4A (Classified under tariff headings 2826, 2839 and 2842) imported from Thailand and Iran for 5 years pursuant to Final Findings issued by DGTR.

India further amended notification No. 47/2021-Customs (ADD imposing Anti-dumping Duty on imports of "Natural mica-based pearl industrial pigments excluding cosmetic grade" 

India customs authority has amended notification No. 47/2021-Customs (ADD), dated 26th August, 2021, imposing Anti-dumping Duty on imports of "Natural mica-based pearl industrial pigments excluding cosmetic grade" (Classified under tariff heading 3204, 3206 and 3207) from China PR, to modify the existing duty table.

United Kingdom: Revocation of anti-dumping duty on Aluminium Road Wheels

The anti-dumping measure on the import of all other wheels of aluminium originating from the Republic of China under the following commodity codes are revoked from 26 January 2022. Declarations code 8A25 for ‘forged’ aluminium road and 8A26 ‘cast’ aluminium road wheels will be required to differentiate between those goods that are/are not exempt. Commodity codes affected are 8708701015; 8708705050; 8708701050 and 8708705015.

United Kingdom: Administrative update to Definitive countervailing duty on ironing boards originating from Turkey and Extension to Current Duty and Covid Import Duty Suspensions

This update is due to the Department for Business and Trade correcting their dataset entry in respect of including a ‘condition not fulfilled’ option on 554 - Definitive countervailing duty measures for ironing boards originating from Turkey as of 05 December 2023 on the following commodity codes: 7323930010; 7323990010; 8516797010 and 8516900051.

United Kingdom: Update to Anti-Dumping and Countervailing Measures on Hot Rolled Flat Coil from China

Anti-Dumping and Countervailing measures on Hot Rolled Flat Coil (Classified under tariff chapter 72) from China have been extended until 07 April 2027. The public notice relates to certain hot-rolled flat products of iron, non-alloy or other alloy steel products (the “goods” it relates to, are described under the heading “goods description” below)

  • gives effect to the Trade Remedies Authority (TRA) recommendation to:
  • vary the anti-dumping duty on certain hot-rolled flat products of iron, non-alloy or other alloy steel products so that it applies for 5 years from 7 April 2022 until 7 April 2027.

The following product types are excluded:

  • products of stainless steel and grain-oriented silicon electrical steel
  • products of tool steel and high-speed steel
  • products, not in coils, without patterns in relief, of a thickness exceeding 10mm and of a width of 600mm or more
  • products, not in coils, without patterns in relief, of a thickness of 4.75mm or more but not exceeding 10mm and of a width of 2.05m or more

United States: Preliminary Affirmative Determination in the Countervailing Duty Investigation of Certain Pea Protein from the People’s Republic of China

On December 12, 2023, the U.S. Department of Commerce (Commerce) announced its preliminary affirmative determination in the countervailing duty (CVD) investigation of certain pea protein (Classified under tariff HTS 3504.00.1000, 3504.00.5000, and 2106.10.0000) from the People’s Republic of China (China).

United States: Final Affirmative Determination in the Countervailing Duty Investigation of Brass Rod from India

On December 12, 2023, the Department of Commerce (Commerce) announced its affirmative final determination in the countervailing duty (CVD) investigation of Brass Rod (Classified under tariff HTS code 7407.21.1500, 7407.21.7000, and 7407.21.9000) from India.

United States: Preliminary Affirmative Determination in the Antidumping Duty Investigation of Non-Refillable Steel Cylinders from India

On November 27, Commerce announced the preliminary determination in the antidumping duty (AD) investigation of non-refillable steel cylinders from India. Commerce is conducting a concurrent countervailing duty (CVD) investigation on imports of non-refillable steel cylinders (Classified under tariff hts code 7311.00.0060 and 7311.00.0090) from India.

United States: Preliminary Affirmative Determinations in the Antidumping Duty Investigations of Brass Rod from Brazil, India, Mexico, South Africa, and the Republic of Korea

On November 27, Commerce announced affirmative preliminary determinations in the antidumping duty (AD) investigations of brass rod from Brazil, India, Mexico, South Africa, and the Republic of Korea (Korea). Commerce is conducting concurrent countervailing duty (CVD) investigations on imports of brass rod (Classified under tariff hts code 7407.21.1500, 7407.21.7000, and 7407.21.9000) from Israel, India, and Korea.
