Canada: Notice of initiation of a re-investigation - Oil country tubular goods and seamless casing (OS 2022 RI)

The Canada Border Services Agency (CBSA) has initiated a re-investigation to update the normal values and export prices, in accordance with the Special Import Measures Act (SIMA), respecting certain oil country tubular goods (OCTG) and certain seamless casing originating in or exported from China. The re-investigation was initiated, in part, as a response to a dramatic increase in imports of the subject goods from China totaling approximately 135,000 MT since the beginning of 2022. The need for this re-investigation was further compelled by serious price volatility in the OCTG market, with world market price indicators rising by 50% or more during this same period. Given these factors, the re-investigation will be conducted on an expedited basis. The re-investigation will serve to address the rapidly changing market conditions and is part of the CBSA’s enforcement of the following Canadian International Trade Tribunal (CITT) orders issued on:

  • November 28, 2018, in Expiry Review No. RR-2017-006 (SC) and
  • December 10, 2020, in Expiry Review No. RR-2019-005 (OCTG I)

The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s orders can be found on the CBSA’s Measures in force.

Exporters that wish to participate in this re-investigation are required to provide a complete and accurate response to the CBSA’s Request for Information (RFI) by no later than November 21, 2022. Information submitted after this date may not be taken into consideration for this re-investigation. Respondents should also note that as this re-investigation is being conducted on an expedited basis, extension requests will only be considered for exceptional circumstances.

Canada: Conclusion of normal value review of Seamless casing

The Canada Border Services Agency (CBSA) has concluded a normal value review to update the normal values, export prices and amounts of subsidy applicable to certain seamless casing exported to Canada from China by JingJiang Special Steel Co., Ltd. (JJSS). This review follows a request for re‑determinations filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on November 28, 2018, respecting the dumping of certain seamless casing from China, in accordance with the Special Import Measures Act (SIMA). The Period of Investigation (POI) for the normal value review was from January 1, 2021 to December 31, 2021.

Canada: Notice of final determinations Mattresses

On October 5, 2022, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA), terminated the dumping investigation in respect of mattresses from China by Jiaxing Taien Springs Co., Ltd. and Xianghe Kaneman Furniture Ltd. as they have not been dumped. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of dumping concerning mattresses for all other exporters from China, for which the investigation has not been terminated. On the same day, pursuant to paragraph 41(1)(a) of SIMA, the CBSA, terminated the subsidizing investigation in respect of mattresses from China by Dongguan Sinohome Ltd., Gold Lion Furniture (Shanghai) Co., Ltd., Guangdong Eonjoy Technology Ltd., Jinlongheng Furniture Co., Ltd., Xianghe Kaneman Furniture Ltd., Zinus Xiamen Inc. and Zinus Zhangzhou Inc. due to no subsidy or insignificant amounts of subsidy. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of subsidizing concerning mattresses for all other exporters from China, for which the investigation has not been terminated.

The subject goods are usually classified under the following tariff classification numbers: 9404.21.00.00;
9404.29.00.00 and 9404.90.90.40

The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by November 4, 2022. Provisional duties will continue to apply on imports of subject goods until the date of the CITT’s order or finding. However, provisional dumping and/or countervailing duties will no longer be imposed on imports of goods of the same description as the goods of which the dumping and/or subsidy investigations have been terminated.

EU imposed a definitive anti-dumping duty on imports of sodium cyclamate

EU has imposed a definitive anti-dumping duty on imports of sodium cyclamate originating in the People’s Republic of China and Indonesia following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council. The product under review is the same as in the original investigation and previous expiry reviews, namely sodium cyclamate, currently falling under CN code ex 2929 90 00 (TARIC code 2929 90 00 10).

EU has issued notice of initiation of an expiry review of the anti-dumping measures applicable to imports of certain hot-rolled flat products of iron, non-alloy or other alloy steel originating in the Federative Republic of Brazil, the Islamic Republic of Iran, the Russian Federation and Ukraine. The product under review is currently falling under CN codes 7208 10 00, 7208 25 00, 7208 26 00, 7208 27 00, 7208 36 00, 7208 37 00, 7208 38 00, 7208 39 00, 7208 40 00, 7208 52 10, 7208 52 99, 7208 53 10,
7208 53 90, 7208 54 00, 7211 13 00, 7211 14 00, 7211 19 00, ex 7225 19 10 (TARIC code 7225 19 10 90), 7225 30 90, ex 7225 40 60 (TARIC code 7225 40 60 90), 7225 40 90, ex 7226 19 10 (TARIC codes 7226 19 10 91, 7226 19 10 95), 7226 91 91 and 7226 91 99. EU issued notice of initiation of a partial interim review of the anti-dumping measures applicable to imports of tubes and pipes of ductile cast iron

EU has published notice of initiation of a partial interim review of the anti-dumping measures applicable to imports of tubes and pipes of ductile cast iron (also known as spheroidal graphite cast iron) originating in India. The product concerned by this review is the product under review originating in India, currently falling under CN codes ex 7303 00 10 and ex 7303 00 90 (TARIC codes 7303 00 10 10,
7303 00 90 10). The CN and TARIC codes are given for information only without prejudice to a subsequent change in the tariff classification.

India imposed anti-dumping duty on "Toluene Di-Isocyanate (TDI)"  

India customs authority has imposed Anti-Dumping duty on "Toluene Di-Isocyanate (TDI)" (29291020) originating in or exported from China PR, Japan and Korea RP, for a period of 5 years, in pursuance of sunset review final findings issued by DGTR.

India customs amended notification No. 75/2021-Customs (ADD) dated 21.12.2021 regarding levy of anti-dumping duty on "HFC Component R-32"

India customs authority has amended Notification No. 75/2021-Customs (ADD) dated 21.12.2021 regarding levy of anti-dumping duty on "HFC Component R-32" to amend the name of producer from “Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd” to “Zhejiang Quhua Fluor-Chemistry Co., Ltd.”.

United States: Final Determinations in the Antidumping and Countervailing Duty Investigations of Oil Country Tubular Goods
